Hi, I moved to canada and became a pr in 2005.
I moved back to england in 2008 to go to university.

I recently put in a sponsorship application for my partner but was declined as a sponsor due to not having botherd to get a passport (whilst living in canada, which I could & should have) and thus not being classed a canadian citizen.

His application is ongoing now regardless, was forwarded to London, and we dont know what type of application it is.
Will it have turned into a skilled worker application?
If so, will we have to send in more details?

thanks!

You weren't declined because you don't have a passport and aren't a Canadian citizen. Both Canadian citizens and permanent residents can sponsor spouses. You were declined for a different reason.

Are you still in the UK? If so, that was likely the reason why you were declined. In order for a PR to sponsor a partner, that PR must be living in Canada when the application is submitted and must continue living in Canada while the application is being processed.

To answer your question, since you were not approved as a sponsor - your partner's application will eventually be refused. No - it won't be converted into a skilled worker application.

You really have two choices: (1) withdraw the application and only submit it again once you have addressed the issue of why you were refused as a sponsor; (2) wait for the application to be refused and then appeal.

Just to add...

It's not clear how long you've been outside of Canada. Have you been in the UK since 2008?

In order to maintain your PR status - you must live in Canada two out of every five rolling years.

Yeah your absolutely right, I just re-read the letter!

It was because i'm still here!

How would I go about withdrawing the application?

Also my partner is planning on applying for the IEC initiative, will this be affected by the failed pr application?

Thank you so much for your previous answer!
