hi.. gud evening.. i just need some question to be answered.. My husband applied for my sponsorship last year and hired a lawyer.. Last sept of this year i got an email from our lawyer that the sponshorship has been refused due to my husband is receiving a support from the government.. But that support is not for him its for his son who is a special child. Is there another chance that my sponsorship will be approved? they are just giving us 30 days to reply for that. he and our lawyer already filed an apeal.. would it take another year to wait for the approval again? thank u and i hope i will make clear to me.. im really depressed.
 
That is unfortunate. It is good your husband has an attorney, because based upon what you have said the refusal sounds like it was likely improper. Unfortunately, there is little alternative other than waiting for the process, as difficult as I'm sure that must be.

I'm sorry to hear that and I hope your appeal goes through soon!

CIC officers can make mistakes. That is why there is an appeals process.

did your husband apply for disability for this child? and it has not went thru yet? and he is actually receiving government assistance (welfare) for the child until the disability comes thru? if this is the case you will have to prove why he is receiving the government assistance ie... waiting on the disability to go thru.
 
Does your husband work or not?
 
sorry for the delay response.. my husband cant work full time right now because of his son 's condition.. he is working part time jobs only if is one of his friend is available to accompany his son.. thats why he wants me to be there so we can help each other..
 
here's my other question.. how come when my husband used to sponsor his half sister before (dont know what year) they didnt having a problem regarding the welfare his receivng for his son..and it only takes 6 mos to process his half sister's documents.. me.. i've been waitng for 2 yrs now since we got married.. still we havent received any reply from the CIC since (sept) they refused my sponsorship..Do i still have a chance to be with my husband if this is the sistuation?
 
CIC has changed the rules.....
 
what rule sir?? can u elaborate this to me plsss.. b-coz i really need to work abroad if it will take another yr to process my papers.. and i cant decide yet coz im hoping that one day they will approved my sponsorship. but if not i really need to apply outside the phils to work for my family.
 
you still have not answered the question.. what exactly is your husband receiving assistance for? this will better help us to answer you...
 
ohh im so sorry sir...as far as i know sir he is receiving welfare for his son who is a special child.. here's the sample of the conversation of our lawyer when we receive the refusal,, it might give you a clear answer to your question..

[This is the reason I want to speak with your husband and see what we can do..kase he is receiving welfare right now, if the sponsor is collecting welfare, the sponsor will be default, meaning cannot sponsor but at his situation is is doing it because of his son Christian.

I will try to work on this to make the foocier change his mind, if not are you willing to go for an appeal?

I understand he is receiving assistance for his special needs son but is it disability assistance or is he waiting for disability to kick in, if he is receiving it because he is waiting for or it is disability payments they can not refuse him as a sponsor and all you would have to do is prove that the assistance he is receiving is due to disability. I know that until the disability kicks in they will give you welfare payments.
 
yes sir.. they submitted some additional documents to prove that is for his son.. so in my case, do i still have a chance to be sponsored by my husbnd?? as you've said before that CIC officers make mistakes too.. and since we did our medical here in the Philippines last Dec. 09 2011, are we going to do it again sir? We did that medical coz it is one of the requirements needed to submit to our lawyer to process the papers..and it will be one year already on the 9th of december.. Do we need to the medical again sir?
 
Yes if your husband can prove to CIC that the assistance he is receiving is for his special needs son (for disability) then they shouldn't deny him as per CIC website states "receive government financial assistance for reasons other than a disability". This may not have been a mistake the way it works is when you apply for disability for a child the government gives you regular welfare payments until the disability is approved and then it switched over in the system as a disability payment, if your husbands child was/is still waiting for disability approval the system would just say he was receiving welfare payments. just a glitch in the system as to how things should be labeled. Yes you were to submit a medical when you filed your lawyer just didn't make you do it, everyone has to do it when filing with or with-out the use of a lawyer, they very well could ask you to do another medical because the expired medical isn't the only thing holding back the process tho they could be nice since this was a government mix up and give you a yr extension. but I would expect they would ask for another medical because you havn't even made it past the sponsorship stage.
