Is it true that to be considered common law in Alberta is 6 months?
and if so does travelling together within one of those months still count as long as we can prove it?

No, not for immigration purposes.

I'm really desperate for help.
can anyone give me a good answer?

in Alberta is it true that common law is considered 6 months or a year?

I'm not sure what answer it is that you are looking for, but maybe this will help....

http://en.wikipedia.org/wiki/Adult_interdependent_relationship_in_Alberta

Direct from the CIC website:
"You can sponsor the person as your common-law partner
-regardless of his or her sex, and
-you are cohabiting in a conjugal relationship and have done so for at least one year."

(found here, under "Whom can I sponsor using this application?")
http://www.cic.gc.ca/english/information/applications/guides/3900E2.asp

This applies to immigration in ALL of Canada.

Are you asking for immigration reasons, tax reasons, family law reasons, etc? You need to be more specific. I've already told you that 6 months living together is not considered common-law under immigration law no matter what province you live in.

for him to be able to sponsor me and to even be considered in a common law relationship. thanks for your replies i got it now, made things a bit clearer.

Hi,

Me and my husband has been married for nine months now here in the Philippines, we are having rough times. I just came back from Canada last July 20 as a tourist, since we are having problem I need to go back soon. I have some questions, I would appreciate any answer re this. Thanks in advance.

1. Will I be granted with another trv knowing I just got back from Canada last July 20? I will state that we are having marital problems and will come back in the Philippines with my husband after his work on December.

2. Is our marriage recognized in Canada even if the wedding was held here in the Philippines?

3. What are my rights as a wife even im here in the Philippines?

Thank you so much.

1) No-one here can answer that for you, only the embassy in Manila can say whether they will issue another TRV. You have to prove that you have the same ties etc as you did the first time.

2) Canada recognises marriages performed elsewhere in the world, so long as it is legal and registered where it was performed.

3) That's a family law question, not an immigration question.

For immigration purposes, no. For tax purposes, your husband will need a certified copy of the marriage certificate to register his change of status with Revenue Canada.
