Hello Guys.

I need help, I just received an email from the VO saying that I do not have enough experience for CEC but I do, I actually had implied status until Start of october/2013 and started working in september/2012 ... (I did not get the work permit renewewal but still I applied to renew before my work permit expired)

Which documents should I submit to the officer? I even have a letter saying this:

We also wish to advise you that your temporary resident status expired on October 7, 2013. Which was when I got refused my renewal for the work permit.

FIRST EMAIL FROM OFFICER:
According to our records you do not have a current employment authorization (EA). Your EA expired on August 14, 2014(NOTE... 2014?? I didnt even have a work permit in this year), and therefore you have not accumulated sufficient work experience to be considered eligible under the Canadian experience program. Your comments on this matter would be welcomed prior to our rendering a decision on your case.

Therefore I am asking you to submit any additional information and/or documentation that would allay my concern(s). You have 30 days from the date of this letter to submit the additional information and/ or documentation to the above address.

SECOND EMAIL LIKE 5 MINUTES LATER

STRANGELY ENOUGH, AFTER THE FIRST EMAIL, HE SENT ANOTHER ONE ASKING FOR SPECIFIC DOCUMENTS, DOES THAT MEAN HE ACTUALLY THINK EH MADE A MISTAKE?!

This is in reference to your application for permanent residence in Canada. In order for us to continue the processing of your application, we require the following documents:

T4: A copy of the Canadian Revenue Agency T4 form for 2013

Notice of Assessment: A copy of the Canadian Revenue Agency Notice of tax Assessment for 2013

Employment Letter (updated): An official document printed on company letterhead stating that you, in whose name the letter is printed, will be employed in Canada for a specified period of time by that company. It must list your name, the details of your employment in Canada.

WHAT DOES HE MEAN BY "WILL BE EMPLOYED"? In the employment letter that Ive provided before it clearly states that I worked until october 12.
 
CEC does not require a job offer in order for somebody to apply as I know. this is too strange. I even have the one year. please experts give your opinion on which documents to submit and what to do
 
They don't, but if they ask for it, will you tell them it's not needed in the application?
Two points why I think they're asking for the Offer/Contract:

- Employment Letter means your contract; otherwise they would have said reference

- the way it's worded (using future tense) could mean the offer letter or contract, as in: "My contract states my position, salary, and how long I will be employed by the company."

I suspect they want to see if you were permanent or temporary.
 
So what kind of documents should I give them? Am I in danger? I worked until October 7th with implied status and just lost the status after that.

According to this http://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-183-20140601.html#wb-cont

(5) Subject to subsection (5.1), if a temporary resident has applied for an extension of the period authorized for their stay and a decision is not made on the application by the end of the period authorized for their stay, the period is extended until
(a) the day on which a decision is made, if the application is refused; or
(b) the end of the new period authorized for their stay, if the application is allowed.

I got refused on October 7th, what do you guys think?

in my opinion, just in my opinion

when he say expired on Aug.14 2014 , it means , it expired on that date too . not since Aug.14

the problem I guess is :

you only submit 2012 T4 , right?

but your experience is 2012 to 2013 .

so you need prove 2013 experience by T4 and CRA notice .

or

something is wrong in your previous letter, the date ????? they think 2013 is the start point of your work ?????
 
I see. Do you guys think that emailing them the documents would be ok or do I need to physically send them? Which documents do you guys think I should send?

I am thinking;

Letter of refusal stating my status finished in October 7th
New letter of employment saying from-to dates
T4 and Notice of T4 for 2013

Anyways can I send them by email? Be said like this:

All documents must be accompanied by English or French translations. When original documents are requested, notarised documents are not acceptable. When attaching your document(s), please ensure that they are smaller than 5MB and that each document is attached individually.

Are you able to get an updated reference letter from your previous company? I think this is important to establish your employment duration. Contract will be the supporting doc. Email will be enough.

Yes, I can get an employment letter.

So I will send the following:

Letter saying that my status was valid (Implied status) until October 07th.
Letter saying that I worked from September 10th to October 07th.
T4 2013
Notice of assessment 2013

Do you guys think it will be enough? I do not have any future contract with that company.
 
Send them the following documents.

- Your all work permit copy to avoid and confusing status in Canada.
- T4 and NOA from 2012 to 2013
- Salary slips
- Reference or employment letter which mentioned about your jobs duration, hours and other details. They need latest one. So do not forget to mentioned about date.

Just prove it that you have more than 1 years experience with all the corresponding documents.

Send them ASAP and copy of that mail so it is very easy for them to start to working on your application.

Submit this along with your written explanation that you had applied to extend your work permit (on what date? any evidence?) and believe you were on implied status, and therefore you believe that your work experience was authorized until Oct 7, 2013...
 
From what I read here one of those emails, most likely the first one, was not intended for you. The VO mistakenly sent you the first email instead of another applicant. The date mismatch is a good indicator as well the short time between the two emails.

Upon re-reading everything, I agree with thisisauser... you might want to reply to the first email and ask if you were the correct recipient of that email...
 
Did they stop sending the confirmation email saying that they received the email?

I didnt receive any confirmation email, which is weird.
