Hello I hired a representative to apply for my work permit extension. But for some reason my application was rejected. The rejection took place after the expiry of my current work permit. So I could not reapply. My representative told me some 20 days after CIC issued a rejection letter. So I kept working for extra 20 days. The thing is I made an express entry profile and the system qualified me under CEC.If I take out those 20 days then it would not be a 1 year work experience and chances are system won't qualify me.

So I want to know what should I do? Shall wait for an ITA and apply for PR and attach the letter of explanation that why I worked for extra 20 days and see what CIC comes up with or shall I withdraw my profile. In case if I continue and attach a letter of explanation in future would I be charged for misrepresentation even though I explain everything honestly?

If you explain the situation, they will only cancel your file and hopefully not charge your for misrepresentation because you provided information upfront. Under no circumstances would CIC process your application since you lack basic eligibility for CEC.

Agreed. You can't count the 20 days.

Ok so what's your recommendation regarding withdrawal? As I matter of fact CIC did not even grant me an implied status because my consultant did not pay the required fee on my behalf. Right from the expiry of my work permit to the date cic has issued a letter there are some 26 days plus it took my consultant some 20 days to tell me so I have worked some 46 days without authorization. So should I withdraw as of now and reapply when I am eligible some time in future or should i play on chance that may be CIC would consider my experience because this is not my fault ( I think). As soon I knew I quiet working.

The reason I made an EE profile is because two other ICCRC told me that I can apply because I worked and paid taxes on my income. So I don't know why are they saying that. They may think I am eligible or they are telling me so that I can pay them to do work on my behalf.

Kindly help

You can't claim that it was the representative's fault and expect CIC to treat you fairly. Choosing a representative is entirely your decision and their actions are binding on you.

Recommend that you apply ONLY when you are legally eligible to apply.

I have already done that :'(. Also it asked me to remove my profile from job bank. What I did, I went to the new job match section and deactivated my profile. Is that enough to remove my jobbank/jobmatch profile or I need to do something else

I imagine that's fine. Hang in there and wait for eligibility without losing hope. Good things await. All the best!

Thanks Asvind!

I got one final question. Since I am under restoration since May 19 2015 (wp expiry date). I tried different avenues to stay in Canada like admission or finding an employer who can hire me on a closed wp. Now, I found all the doors are closed so I have book a flight ticket for 14th Aug. One CIC agent advised me I can leave anytime before my restoration ends even though I don't apply for any thing like wp/studypermit/visitor. One agent said if I don't apply for restoration I have to leave immediately and as such I am illegal. So what should I do? I have 10 days and I am still trying. I just don't understand what do they mean by immediately.
