Hi all, we applied our spousal sponsorship (inland) in June 2014 and applied for the pilot work-permit program this year.
I just received a reject letter and it's just so wrong!


This letter refers to your application for a Work Permit.
Based on your application and accompanying documentation that you have provided, I have
carefully considered all information and I am not satisfied that you meet the requirements of the
Immigration and Refugee Protection Act and Regulations. Your application as requested is
therefore refused.
[X] To be issued an open Work Permit (WP) you must be currently in Canada and have
submitted an application for Permanent Residence (PR) as the principal applicant under the
spouse or common-law partner in Canada (SCLPC) class.
You have failed to meet the eligibility requirements for an SCLPC open Work Permit because
your application for permanent residence has been rejected. For further details on eligibility
requirements please see our website at:

[X] We also wish to advise you that your temporary resident status expired on June 11, 2015.
You may apply for restoration if, within 90 days from the expiry of your temporary resident status
you submit:
 a completed application form;
 applicable fees for restoration and for the immigration document(s).
Payments should be made online When
you are finished, you must print the receipt of payment and include it with your
application.
 all required documents in support of your application.
Please consult the section “Restoration of status” in the application guide: “Applying to
change conditions or extend your stay in Canada”. Restoration applies to each member
who has lost his or her status. Please note that there is no guarantee your application will be
accepted.

Should you choose not to apply for restoration of your status, you will remain a person
without legal Temporary Resident Status and as such will be required to leave Canada
immediately. If you do not leave Canada voluntarily, enforcement action may be taken
against you.

First of all, my PR application is not refused. It's been submitted June 2014 and returned once (CIC blamed me for their form update and asked me to submit the 2014-August version, which isn't really my fault for sending it prior to their update of the form) and I sent them back in accordance with their requirement. I called the CIC call center and they told me i'm still on the waiting list as CIC is processing 2014-Jan applications. How does it make my application rejected?

Second of all, I applied for my 6-month visa extension on 2015 April 16 via online and I'm still waiting for the result. Why does this officer put my status expired regardless of my application and I have to pay another money for restoration of my status?

It's already devastating to just sit and wait for the chance to feed my family when my wife stopped working as she is 8 month pregnant. This reject letter really wants me to cry. Please help correct the mistake and help me function as a dad-to-be financially.
 
I would suggested contacting your MP. Hopefully yours is of the helpful sort.
 
Can you give us more information about you history in Canada?

What was your status in Canada when you submitted your original inland application in June 2014? How long was your status valid for at that time?
When you resubmitted your application in August - I assume you submitted the OWP along with it? Or did you apply for the OWP later / separately?

I have two UCIs.(i don't know why I have two). I was a tourist when I first came in Canada 2014 Jun. I had 6 months and extended my visa online once. I applied another visa extension 2015 April 16 and haven't seen any update yet.

I submitted my OWP application separately after the official announcement of pilot program on CIC website.
