hello all,
first id like to thank anyone who takes the time to read my situation, in advance. thank you

i have been dating my girlfriend for the last 2 years, we have traveled as visitors to each others country numerous times, me 10+ times to see her, her 4 times to see me here in canada. we have never extended our visitor visas, when she comes here she returns home before her stamp expireres always.

my girlfriend has a 4 year old that is always in the care of the grandmother when she visits. the father is non- existant.
my girlfriend is currently here in toronto, and has her visitor stamp expirering in october- mid.
we are plannning to be married by aug, 10.

so here comes the questions now that you know my situation.

1. am i correct,
i need to get married, with purchase or marr/lic

-apply for the marrige certificate.
-get the medical done
-submit the application for sponsor + submit the PR application
- visit the immigration before visitor stamp expires and apply for extension due to sponsor/PR application in process

2. as of my current pay scale i am on track to making 27,000
my past 12 months show 21,000

due to her having a dependant 4 year old back home that will not be sponsored at this time or any time soon,
does that make me responsible for the income portion.?

3. since the 4 year old will not be sponsored, i must include her in the portion of the sponsor application where it states dependant chilren whether sponsored or not.

4. can i get the medical done now to save me the time, assuming it will be valid for when i submit the application.

5. i know many choose to do this process on there own.
i am educated enough to pull it off. but would it be better in my case to put it into the hands of a lawyer considering i have only, 100 days roughly untill her passport stamp expirers

Are you sure you want to do an in Canada sponsorship? As you may have read on this board, there are certain problems with it. One is that she is not supposed to travel while it's in process which could easily be 1-2 years or longer. If something happens in her homeland in the meantime and she needs to go back, she risks losing her application and waiting time. Also, if they want an interview, they will forward her case to the local CIC office without giving her the normal first stage approval after 5-6 months which means she will not be able to get health care or a work permit. Depending on how busy the local office is, you may wait for this interview for up to 3 years. If there are no problems at all, she would have first stage approval and work permit if you applied for it after 5-6 months and PR in 1-2 years.

If you apply outland, she can still travel if needed without risking her application but she can also stay in Canada if she wants to. Processing time depends on her homeland, you can see it here: http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp and add to that about 7 weeks in the beginning to approve you as her sponsor. There is no work permit for outland, straight to PR.

You do not need to prove income to sponsor your spouse or kids, even if they are the spouses kids. Her kid will have to be listed as a non-accompanying dependent and will also have to have a medical.

It doesn't really matter if you get a lawyer. It will not make your application faster. You can start looking at and filling out forms now to get everything prepared.

i have no problem on waiting, patience is key. something i have and will explain to my soon to be.
since there is a kid involved, i thank you for the points you mentioned about having to return.

the way you explain it it just seem logical and more sense to do it out of country, which i have no problem doing.


i just have my girl here prepared to marry and i had a belife that it would be logical to start the process now with her here.

but with her there, here country site is mexico city, she lives nowhere near it. would she have to commute to and from that city to do any immigration work.


what if my girl is prepared to do a long stay here. and i dont need her working in the immediate future.
is there any instance when a in canada process in my case would work.

aswell you said the child would need a medical done, where is that needed to be included in the application

If you apply outland through Mexico, the only reason she might have to go to Mexico for immigration purposes would be if they want an interview with her. Otherwise it's all done through mail.

What you can do is apply outland but give a mailing address in Canada. She can still stay with you in Canada. When her visit visa is 30 days from expiring, apply to extend it. Last time I checked, visit visa extensions were taking about 3 months to process so while she doesn't hear back, she's under implied status.

You will find all your forms for outland application at http://www.cic.gc.ca/english/information/applications/fc.asp In the "Part 2: Immigration forms - Guide to Immigrating" at http://www.cic.gc.ca/english/pdf/kits/guides/3999E.pdf you will see on page 5 and 6 where it refers to non-accompanying family members and how they need to be listed and examined.

In some cases, inland works for people but that is mostly when they come from a country where the outland processing time is very long and they absolutely don't need to travel. It's a very big downside with inland with the travel, say you have already been waiting a year and lets say something happens, her mom is sick, her kid is sick and she needs to go back, she would risk losing her application and all that waiting time. There have been cases of inland where a person has their work permit in 5 months and PR in 10 months but there are also cases where people have gotten stuck in the system and waited up to 4+ years with no work permit, no health care and no PR.
 
leon your info is very educational, and helpful.

i belive that i will go through with the marrige as planned then have her return home and process the application.
use her mailing address at home there in mexico.
like you said unless she is required to go for an interview, then everything is done by mail.
we are willing to wait to cross that road, if nessesary, she will travel to mexico city for the interview.

so am i correct when i say that.

see will return, get the medical for herself and the daughter done there.
i will fill out the application with those certificates of clearence.

suppose all goes well,

all the papers will be done by mail and she will recive the document to return here in the next 7 month to 1 year whatever it take. with her PR status documents.

when she returns does she now land as a immigrant with working status, and medical status, allowing her to work.

or is she needed to get a work permit?

Well, if you want her to stay with you, she could stay with you in Canada for outland also. She would just need to apply to renew visit status. Her mom could probably take the daugther to get the medical but if it works better for you that she wait in Mexico, that is ok too.

When she gets her PR visa, she can come to Canada and yes, she will arrive with full PR status and can right away apply for her SIN and health care (health care sometimes takes 3 months to get as you may know) and she can look for a job without needing any permit.
