Hi please help,

I am 8 years separated but not yet annuled. i am using my maiden name in my passport. But i used my married name to my credentials, IDs like SSS and employment. My boyfriend for 3 years (who is a Filipino also with PR), wants me to visit him this December. He said he plans to marry me when i get there so i can apply for Spousal Sponsorship, and it is also faster than applying Common Law. My problem here is, i have declared in my application that i am single. My temporary visa (visitor) application has been submitted already. Is there a possibility that i would get in trouble in the future? Please share your thoughts. Thanks in advance for those who will reply!

You could get in trouble, yes. You lied on the forms.

You can't get married in Canada until your annulment has gone through. Otherwise you would be committing bigamy by being married to 2 people at the same time.

As explained, getting married is not an option since you aren't yet divorced. You have to wait until your marriage is annulled before you will be able to get married. At this time your only option is to live with your boyfriend for a full year to become common law and then apply.

When you apply for PR, you must mention your former marriage in the application. Failure to do so is misrepresentation and will result in a refusal as well as a five year ban from Canada).

Also, what can possibly happen if they find out that I am not single?

It may complicate your PR application process since you stated you were single when you weren't.

Thanks for your advice Scylla.

What if i will not push through the PR and just visit there instead? my application that i submitted is just Temporary Visa (visitor), will it still complicate?
