I have a friend,he got married in Pakistan to a Pakistani Girl and after feeling that the girl n their family members were just after Canadian Visa and wanna use my friend to just get to Canada,my friend dropped the idea of sponsoring her n now they r living separately,there are few things I wanna ask:

1>If she tries to apply for Canadian Visitor Visa,will she be able to get that? if she does then what sort of legal things she can do against my friend on reaching Canada?

2>Is it a good idea to submit an application to Canadian Embassy in Pakistan and tell them the facts of this fraud marriage,so that if they wanna issue her the Canadian Visitor Visa ,they might wanna have a look at that?

3>She is also threatening that she will put false charges of assault,mental torture when she is gonna be in Canada,my question is Can she put these false charges against him since they are strictly related to Pakistan n they have never ever lived together in Canada?

Pls let me know what u think...

1.1 She will be able to get the visa if she meets all the requirements for one. Unfortunately, being from Pakistan will not help her case unless she is able to prove strong ties to her own country, and that she will be able to financially maintain herself here during her stay.

1.2 Since they were actually married, she may have some rights as a spouse. I am not sure how that would work since she is not a canadian citizen nor a PR holder. I'd look for professional advice on that one.


2. Well, it's up to him. If he is 100% sure she was trying to scam him, then I'd report her to the embassy. Just make sure to build a strong case.

3. Unless he did something very serious with her and she is able to prove her allegations, then she may have a case. Although I doubt the Canadian court would allow her case to be processed here since they were not in Canada.
 
If you mean fraud marriage and your friend agreed for that and presented false statement, your friend will be in big trouble as he is part of this fraud

If your friend was misinformed and he is not aware of any fraud and he was used without his knowledge then it is better to immediately Canadian embassy in pkastian not to issue any papers and let them know of the separation
 
After marriage husband realized he is in some kind of trap and start living separately though the marriage legally stands. If he decided to end the marriage then there is only two option for him, mutual divorce or file a legal divorce petition to their civil/family court but he has to present grounds for filing of one way divorce petition and that may take some time to settle. However, filing a one way divorce petition, there might be financial consequences as per the marriage terms and country marriage law which is subject to court jurisdiction..

At the same time he should inform Canadian consulate with support of his legal documents to keep his marital status informed. Once he informs she will not be able to get immigrant visa (as consulate will require husband sponsorship documents/petition) but she may get visit visa if she qualifies.

Whatever the situation he is in, my advise will be to discuss with a credible marriage counseling lawyer for legal assistance without delay... Good Luck..
 
1. A visitor visa will be issued if she meets the requirements. What do you mean by legal things? Why should anyone in Canada be involved in her business as and when she comes if she is a law abiding visitor?

2. Is there a sponsorship application in place? If so then sure the visa post will need a letter withdrawing the application including the reasons. If there is no sponsorship application then its less relevant since there is nothing to cross reference. If you mean having a letter so she never gets or has difficulties in getting a Canadian visa it may be peace of mind for him but its not CIC's job to police relationships that have failed which have no immigration related aspect to them. CIC will issue her a visa if she proves she is a bona fide visitor.

3. Canada has due process so false accusations can in themselves lead to consequences including charges of wasting police time.

Reading between the lines the problem is about the wife getting to Canada. Your friend should end the marriage and move on with his life. Thinking too much about his to be ex wife and her future travels to Canada to 'punish' him isn't of any use to him.
