Well spoken dear.
Thank you for putting so much effort to frame the information, how refugee sponsorship is different from family sponsorship. I am not against any immigration stream, as I started my journey in Canada using one of them. My concern is if they can bring 25000 in 100 days, during hostile situations in some war-torn countries, why can't they process the outland spousal application on this pace as every country is facing a COVID-19 war, or at least grant a visitor (TRV) to the spouses living in visa-required countries (remember they are immediate family members of a Citizen/PR, where AS refugees are not). COVID-19 has built a huge backlog for IRCC, they can take their time to process applications, but while they are processing that, at least they should put some measure to reunite Spouses to their loved ones in Canada.

Thank you for mentioning your situation and you are lucky that your husband can get eTA to fly to a Canada (costs of an eTA CAN$7). Here is mine, and I believe it represents the majority of Outland Applicants (https://www.immigration.ca/canada-to-spend-148m-on-boosting-intake-of-international-students-from-different-countries), My spouse is from India, and she's living a perfectly fine and healthy life. and working full-time. We got married last year after being in a long-distance relationship for years. I applied for her Visitor Visa (for Visa required countries (Cost CAN$100)) before marriage and after marriage, after Trudeau's announcement, I believe many did (https://www.cicnews.com/2020/06/trudeau-families-can-cross-canada-u-s-border-tomorrow-0614599.html#gs.fffzes), but both times got rejected, even after showing $50,000 in our accounts as a liquid from 6 months of statements, she holds Officer rank 1 job and I am an essential worker. I got a letter from my employer, to support the Visitor Visa application as well.

The application was put on hold, however, our application was qualified to apply under the immediate family member category and got the following response, even after following a complete set of instructions and providing evidence:

"Based on our assessment of your recent enquiry, we cannot process your request as you have not provided sufficient evidence that you meet an exemption criterion and/or that your travel to Canada is non-discretionary, per the travel restrictions implemented to prevent the spread of the novel coronavirus (COVID 19) in Canada.
Even though you do not meet an exemption criterion and/or your travel has not been deemed non-discretionary, your application will now be put on hold until after the travel restriction pause has been lifted."


When they started the process under regular applications the application got refused in One day. This is what happened to most of the applicants who applied after Trudeau's announcement on June 8th, 2020.

With one of the easiest and simplest studies permit requirement and getting PR after that, I have been through this channel myself and secured my PR in 4 years(study+work+PR application process) now a Citizen, I do not think Canda is not a major country that is facing Marriage frauds like as UK and USA face.

As I've said earlier, I am not against any immigration stream, but if Ottawa can come up with all the measures for Students, Inland spousal applications, Refugees, then why Outland spousal applications left in dark.

I want to bring all this to official attention, and I'm trying this day and night to change this for outland applications, so that, this can be productive to future candidates like us, who wish to bring their loved once here. It is Canadian Citizen/PR taxpayer rights, not a privilege, everything should come after County's own Citizens and PR. Hopefully, you can place yourself in our shoes and understand what we are going through.

One important note on this: I do not know how you applied and what you marked, but as a spouse you SHOULD meet the non-discretionary travel exemption (immediate family membership reunion is "deemed" non-discretionary).

This does not mean you will be issued a visa. BUT: the response indicates that somehow in the application or how it was evaluated by IRCC they did not categorise it as meeting this exemption. In my view, you should not have received this message if you showed you met this criteria properly.

As you (I think?) mentioned, some of the files are handled at least in part by computer.

IF THE APPLICATION IS NOT CORRECTLY 'CODED' TO DEMONSTRATE THE EXEMPTION CRITERIA ARE MET, IT WILL BE REFUSED.

So yes, it is possible that you have not applied 'correctly.' No-one can say for sure. You may want to look carefully into how the TRV under immediate family reunification must be applied for.

I don't have the information on how to do this, there have been cases in this forum and presumably in the TRV forum here. Also worth considering where else to get useful advice, including outside firms or MPs, etc.

Again, none of this means you WILL get a visa. But I don't believe you should have received THAT refusal language.

Your spouse should have received an email asking her to provide her biometrics! Got the same thing last Friday.

Thanks for your response, I'm pretty sure, I followed all the instructions and even including SOP from both sides. I've been dealing with all these applications from last 10 years total 14 applications and helped my friends (Student Visa and renewal, Co-op Work Visa and renewal, Student off-campus Work Visa and renewal, PNP Application, Express Entry Application, Parents Super visa Application, Extending stay for parents, Citizenship Application, Parents Sponsorship Application, Spousal Sponsorship Application, and finally Spousal Visitor application) and I'm pretty sure this explains why. I have tried calling them, submitting Web forms twice and all I got this:

I'm sorry I can't give better suggestions, except to suggest looking through threads here and checking elsewhere. Some have succeeded in getting them with specific combinations referring to covid, family reunification, etc. I honestly don't know, but it really seems that you should not be getting the message you received above. (Again, of course, none of this is a guarantee you will get a visa).

Perhaps also worth considering ordering the gmcs notes or otherwise trying to get info.

Hmmmmmmm it's super crazy and very frustrating, I submitted this application on 4th November 2019 and they are now returning with reasons best known to them, I thought they said they won't return any application amdist covid19, they could have requested for any additional documents than returning my package after 10months this is not fair at all, they never gave me AOR number I fellowed up so many times and this how best they can help me after delaying me for 10 solid months.

Another user mentioned this is often due to missing signatures which wouldn’t be covered by the exception for missing documents unfortunately. Surely you received some form of explanation as to why they returned the package?

Yes you are right, I think they are asking for signatures of my family members who will not accompany me.

Does it mean when I submit a new application then it will join the que.

I’m not sure that could be why they returned it, additional family members don’t sign the form you just need to include their details. Did both sponsor and applicant sign all locations on the forms that required signatures?
I’m afraid when you resubmit the whole process will start over again.

It depends on the decision of the immigration officer that will treat the application. I will advise you to include a copy of the Refusal Letter sent to you for whoever will treat your new application to be aware that it was returned. Perhaps you be shown consideration to jump the queue. Again, it depends on the immigration officer’s judgement but I have a feeling you will be fast tracked if the application is corrected and returned as soon as reasonably possible. Hope this helps.
