Looking for some help - my husband is here on a vistor's visa (extended) we are currently in process in Buffalo for a spousal outland PR. His grandfather is dying in Seattle - how safe is it for us to go to the states and for him to get back into Canada? Your comments are appreciated!

There are no guarantees.

Without knowing more information it will be difficult for anyone to answer your question.
Would you travel with him, has he had problems getting into Canada in the past, what country is he from, etc...


In the end the IO will decide if he can enter.

Husband is from the US and we have not experienced any issues in the past however we have not left since we applied for the PR. Yes, I would travel with him. We were married this past July......we have been in process via buffalo since November 15th.....it is totally up to the IO isn't it? Drag....I'm thinking we would be taking a chance? That would be brutal if they said he couldn't come back in. We have an extended visitors visa until May 17th, 2011. Thanks for your comments - much appreciated!

Is this an inland out outland application?

When you say visitors visa extended, do you mean he applied for an extension to stay and received a visitor record?

As a US citizen there should not be a problem, assuming the PR application was outland.

The extended visitor record becomes void once he leaves the country. If he's allowed back in, he will get another visitor record.

Thanks for your comments - wonder what the odds are? Who knows.....it would be horrible if they didn't let him back in or if they only extended him another 2 weeks or something.....
We are expecting the PPR anytime now.....

Sorry, yes we applied for an extension to stay and received a vistor record - he entered last May 2010, that was over November 2010, we applied and received an extension until May 2011.

Not correct, he is a US Citizen, so he is visa exempt - maybe what you meant is, he can apply for another extension in the future.

I did not say visa, I said visitor record. The document/passport stamp that tells you how long you're allowed to stay in the country.
 
I personally would not risk it since it is dependent on a human and not a government rule. I only say this because I was given a visitor record from a border guard and really there was no reason for it so now I am super "gun" shy of the officers. However I say if you bring proof of the already approved extension, the pr app in process you may just be okay. It is a risk though not sure what the odds are. Maybe you will get another visitor record for even longer than May 2011? I would copy that record though since at least on mine I had to hand it in to the Canadian side before crossing.

Bonbon9 I was not suggesting that he needed a visa or that you had suggested he did. I stated that he was visa exempt.

A visitor record is not always issued at the POE, but it can be if the IO decides to.
I suspect that most visa exempt travellers do not receive visitor records at the POE.

But if an extension is granted at a later date, a visitor record is issued.

He is from the US and so should have no problems coming back to canada.
Just my opinion. I experienced the same thing a couple of years ago.
 
Sorry to hear about your husbands grandfather. I would go. Life is far to short and I wouldn't never let immigration stand in the way of me being beside someone I love in their time if need who I may never see alive again!!! I would travel with your husband take all documents (application, receipts) needed. All communication up to date from Buffalo and take the risk.

I would never want you to regret the decision if you choose not to go.

You're in my prayers & thoughts.

Just my opinion. I experienced the same thing a couple of years ago.

Like you pinklady, I think I would make the trip.
I would take copies of the PR application, copies of the documents, wedding certificate etc.

When traveling back, if the two of them are together, with all the proof, there should not be a problem.
It won't matter that the current extension is void, with a PR application in place they are likely to be granted six months.

If they are questioned at secondary, when talking to the IO, just be honest about what has happened - they are not all heartless monsters :)
