yes it was happened to my case, i apply for permanent resident under live in caregiver program last year 2012 after 2 1/2 months i received open work permit. i just got my refusal letter Jan 22, 2013.
before i applied for open work permit i received a renewal for work permit before my 24 months period to caregiver program. the remarks stated are: LMO # ___ is valid for 2 years as of nov 2013 no longer in LCP program.. eligible to apply for permanent resident after completing requirements
The immigration officer said i am not "IN" in to a caregiver program class as i came here as skilled worker coz i did not exit when i changed employer.
they said in order to get into the live in caregiver program class i need the appropriate procedure to assesed all my requirements but it should be done outside canada.
I am thinking of applying thru Humanitarian and compasionate which i think takes longer. but i do hope i can find immigration lawyer to help with my case to appeal but i know hiring immigration lawyer is cost expensive.
