Dear Seniors,

My NOC is class A, 3152-Registered Nurse. Presently in Saudi Arabia. Holds Canadian Registered Nurse License(Manitoba). Got job offer from a Canadian employer from Manitoba, has positive LMO. Yesterday i submitted our application to the Canadian Embassy here in Riyadh. I applied for working permit, while my spouse and my 15 year old son applied for multiple entry visa. The guideline says that we should establish ties to give the VO the impression that we will not overstay in Canada. And because of this just to make sure that the working permit application will not be denied, we decided that if granted the visa, all three of us will land Canada at the same time, but spouse will be back after 45 days to Saudi Arabia, while myself and my son will stay in Canada, myself on a working permit, and my son on a TRV (multiple).
Now my questions are:
1. My son is a minor, entering Grade 11 on September this year, Does he need to apply for a study permit within Canada? Or it is no longer needed as my son is a minor and I am having a work permit with NOC classA. If it is indeed needed, is it possible to apply for a study permit from inside Canada after entering on a multiple entry visa? Or my son needs to leave Canada and apply for sutdy permit outside of Canada.
2. Since my NOC class is A, does my husband automatically gains open working permit too? If not, can he apply for a change of status from within Canada? I mean, after entering Canada, can he apply for a working permit from within Canada or He has to leave Canada and apply for working permit from outside Canada?

Your son does not need a Study Permit to attend secondary school but will need a study permit when he enters college/university.

If you did not specify that your husband is applying for a WP, he will have to apply for a WP either at the POE or within Canada, should he be granted a TRV (visitor)

Just this morning I got my application package back. Canadian embassy here in Riyadh returned it unprocessed with a short letter that the form used for my son's application was wrong. I used a visit visa form for my minor son (multiple entry), but the visa officer who checked it said "study permit" application form must be used for my son. It also indicated that the bank draft for our application form was incorrect because i paid a total of CAD $450 (work-150+2 multiple entry). The officer said we must pay only CAD$ 425 specifically mentioning: wife 150+husband 150+125 for my son's study permit.

I really do not know how the visa officer assumed that we have the plan to enroll my son in Canada? What if there was really no intention of enrolling my son to any school in Canada and the intention was just to visit Canada for 45 days? Jobseeker, the guidline in the saudi arabia visa office is really confusing. there is a section in the website that says there is no need for our son to apply for a study permit since he is a minor and a dependent of a working visa holder. But there is also another section in the same website that says that if dependent child's age is between 6-18, a study permit applicatin must be submitted.
Jobseeker, please help. How about the first bank draft that I made, can i still cancel it? Will the bank give me back that money? My application was returned the next day they received it.

Thank you Leon, with the link that you just provided plus my real life experience just this morning, 100 percent we can conclude that study permit application must be submitted by accompanying minor dependents of work visa applicants. Thank you.

Guys,

I called St. James Assiniboia School Division in Winnipeg Manitoba, the city where I will be working. From this office I learned that minor dependents of working permit holders in Canada are not paying tuition fees up to grade 12. Cheers!

Hi, I am in Canada now on a valid working permit. Can my husband and children 11 and 3 years old follow/come? I plan to have my 11 year child study here... Can I apply for his student visa here in canada though he is Manila? Please enlighten me on how to go through the application. Many thanks

If your job is skilled, your husband can apply for an open work permit, your older child a study permit and your younger child a TRV based on your visa. However, they still need to prove they will not overstay.
