Hi i need small info regarding travel exemptions to canada . Me n my husband are stuck in india..My husband has valid closed wp til april 2021, but he was transferred from canada to india in his company due to covid, so he resigned his job n he is in his notice period now.
I have a spouse dependent open work permit till april 2021 and also have a job to rejoin in canada. So based on the two attachments below. Is he essential or non essential traveller ???
Does he need an written authorisation from ircc for entering into canada?
Or as he was in canada earlier in 2019 and can come back though he is laid off ???

How long have you been outside Canada. Because your husband quit his job he can’t work in Canada unless he secures a new LMIA and closed work permit. He does have a work permit but without being able to show he has a job, he may be denied boarding. You can take a chance and try to board. Or since you have a open permit, he can travel with you as immediate family which requires authorization letter.

You may not hear from the for a while. For you to enter, you need your job letter & showing that your employer supports you quarantining for two weeks which is mandatory. Apply for authorization to travel while you wait for an answer.

You don’t need an authorization letter, but you need

  • You’re a worker who meets all of the following:
    • has a letter of introduction for a work permit (open or employer-specific)
    • has a valid job offer
    • can work once you enter Canada and complete your 14-day quarantine (unless you’re exempt)

Yeaa.. what about my husband? He allows comes under this point right?

  • You have a valid work permit and normally live in Canada.
    • This applies even if you’ve been laid off.

He wasn’t laid off, he quit. And you have been out of the country since March so they may not think he “normally lives in Canada.“ You can book tickets and try to both enter. If he is denied boarding, he will need written authorization to travel.

I mean he was transferred to indian branch as a part of cost cutting right, Which makes me jobless in canada. So which implies he has no job in canada anymore.

Ok still the same, he wasn’t laid off. He was transferred & quit. He can’t work in Canada without an approved LMIA. As i said if you really want buy tickets & try to board. If he is denied, he then will need authorization.

My ICT visa is approved last month and received POE letter. My wife’s open work permit is approved and she has also received Poe letter. But she does not have any job offer. We have booked the tickets already for 1st dec and requested travel authorization for my wife on 17th but did not receive any response yet. Anybody knows how much time it is taking for them to provide travel authorization and if authorization is getting approved in such cases I.e. spouse is traveling on open work permit without job offer.

Would really suggest getting approval for your husband especially if you can't get a refundable ticket or if you wouldn't return if he was denied boarding. Do you have a home that you have been paying for since March? How long do you have left on your WP? In many provinces you have not met the residency requirements for healthcare and you must reapply. You are likely to be asked whether you have been working from your employer since you returned to India. If you have been that would be something for your employer to include in their letter. The other questions is likely to be why are you returning now if your husband is unable to work and it has been 8-9 months.

Hi we both have valid workpermit till april 2021, and i have open work permit.
my employer is still willing to let me work once i finish myquaratineperiod.
we never applied for healthcard and probably won’t be able to apply now so may be wil get them after getting PR.
We don’t have a home that we paid for but we replaced someone in our place in our payinh guest accomodation before we left to india. I have been in canada for more than 2 years now while my hisband landed from chicago in aug 2019 on his closed work permit.
I am sure it is safer and appropriate to get an approval before he travels. The thing is we got pnp invite and likely to receive ITA in next draws so we prefer applyinh for pr as inland as it would be easier to apply for bridge open permit for both us.
And also the written authorization letter request had been submitted to them but it is taking longer than usual time so dont wanna delay and checking in the forum if he is actually eligible or anyone who has been through situation would be a great help to me.
thankyou for responding btw.
