Hi All,

I had applied for express entry CEC under NOC 1221. My application was rejected stating that my job roles and duties did not appear to be consistent with those listed on the NOC website.
However, my colleagues had applied under with same job description and their PR was accepted.
Now, my PGWP is expiring in August 2019.
What options do I have?
Can i apply under same NOC 1221 by modifying my duties?
Please advise...

Yes, apply as soon as possible. Get a new employment letter with duties that match your NOC. Nothing to worry, happened to many people and they successfully reapplied. Can you share your NOC and duties that got rejected?

Your friend might mentioned the correct duties to the particular NOC, here is might be the difference. anyway, apply as soon as possible. in case your application has just rejected, you might prepare a new reference letter with the correct duties and send it to the IRCC seeking appeal provided the reason that got your application rejected is not longer existed. good luck. When exactly did you get rejected from your AOR?

I had applied under NOC 1221 - Administrative officers.
My medical was approved, and I got rejected after medical got approved.
I had requested for GCMS notes and as per the notes; only my duties are inconsistent, because officer was not fully satisfied.
The notes also shows that they had tried to call my HR thrice but all attempts were unsuccessful, could this be the reason for rejection?

So you passed the medical exam and got rejected at the same day? As for reason.. It's hard to tell.. if some of the duties were not fully listed and they tried to call to double-check, cross-reference and nobody picked up then maybe yeah.. they were not fully satisfied you performed everything.. really hard to tell.

Why don't you more articulate your duties?
The letter might say too simple or missed details to fulfill the eligibility.
That would be weird if you change either NOC code or duties. The facts that you worked as NOC 1221 is not going to change.

One of work experience on my application is also noc 1221 and I also passed the medical test.
It hasn't been a month since the MEP though.
From time to time, I concerned there might be odds that my application got rejected because of lack of eligibility.
That can happen to anybody. We only apply for PR once usually..not an expert at all.
If I were you, I would focus on rewriting the letter with your employer.

I thought it wise to tell you these first to give proper context to my story as I seek your advice

The reason for refusal was my foreign work experience. They said they don't believe I did all I claimed I did in the letter of reference I submitted. When they deducted the 50 points for the work expereonce, I then fell below the lowest crs points for my round of invitation, and then subsequently refused. However, they didn't give me 15 points for my Canadian education (a lawyer pointed this out to me last week) and if they had done so, I would still have qualified even with the 50 points Because the letter stated that when they deducted it, I fell below the minimum crs points. So the lawyer representing me for this is saying that we should do a reconsideration for this and we are doing it this week.

Pls what do you think are my chances?

Is there any time frame for submitting reconsideration after receiving the refusal letter.

Pls someokne help me...

It is hard to say, we have only the above paragraph to go on. If your lawyer is correct, however, you should request reconsideration, ASAP. Should not have waited this long, but just do it.

Your bigger problem is, it sounds like you are in Canada without authorization. You could have applied for a bridging open work permit (BOWP) and continued working. If your lawyer failed to advise you of this option, they are incompetent in my opinion. Did you not apply to change conditions to a visitor permit, restore status, anything? Because IRCC does not approve PR applications for people who are in Canada illegally...

I already applied for a study permit and paid restoration fee too. My bowp was already refused too because pr was refused.

How can you apply for a study permit again PGWP only once in a life time and you cannot study again ?

How can you apply for a study permit again PGWP only once in a life time and you cannot study again ?
You can apply for as many study permits as you want to. You just cannnot apply for a PGWP again.
