Hi,
I am Indian citizen who came to Canada on study visa in Jan 2012 but my study visa didn’t extend in 2014 since then I have been living illegally in Canada. I don’t have any criminal record. I met my husband in 2016 and we start dating and after dating two years we decided to get married in May 2018 and filed an inland spouse sponsorship application also My husband has three kids from his previously common law partner. we have all the evidence call details, marriage photos with friends and family,just to make our case strong also we know everything about each other and prepare for the interview. Butwe haven’t heard anything from immigration yet we applied this year in February.. does any one know how long does it take to process application and when immigration will call us for interview and chances of getting approved this application any similar case got PR ?

It takes approximately 1 year for normal applications. Yours might take longer due to your immigration history in Canada.

As long as your relationship is genuine, you should eventually get PR.

Yes my relationship is genuine . Is speeding ticket is an offence? I actually i was driving my friends car with my expired license and got pulled over by a cop and got speeding ticket which I haven’t paid till now, this was three years ago I couldn’t go to court to pay it because I was afraid of my illegal status. Do you think this can affect my application.

Are you sure speeding ticket is the only outcome of that particular incident?

If you were ticketed for a serious driving offence, it could be an issue.

Are you sure you weren’t ticketed for not having a valid license or insurance. If you are still driving stop. You could be liable for millions of dollars if you get into an accident and kill or disable someone.

I don’t understand people . Here without authorization, driving without a valid liscense, not paying the ticket for that violation, and more than likely no insurance . You’d think that if you are here without authorization you’d do NOTHING to bring attention to oneself, guess not

I think you are right but sometime few circumstances does not support you. May be she did not know she was driving Car with expired licence and end up getting pulled over and things multiplied.

So for her question if this would affect her application. Some of the speed ticket are criminal offences ( i guess if you are 50 k over limit) if its just minor ticket. I don't think you will have any issue but if its criminal offence it might affect your application. To add, if you do not have valid status, generally border security would come knocking at your address or send you a letter to come to their office once they are notified by IRCC.

Unfortunately there are too many people without status in Canada to go after everyone for removal. OP is out of status and knows it.

Yes you are correct to say there are many people in Canada who are out of Status. But Government agency does not work like that, for example when IRCC knows you are out of status they are bound to share information with Border Services. Once Border Services gets those information they are bound to look into it, unless they are overworked and do not have main power to do that. If you know anyone who has applied under Inland spousal sponsorship and out of status ask them. They generally get visited or appointment with Border Services is scheduled.

There isn’t the manpower to look for everyone so unless you have committed a crime or come to the attention of IRCC or CBSA for some reason you may be able to live in Canada for quite some time.

I beg to differ . If the o/p never paid her outstanding traffic ticket because they were afraid it would bring attention to her status , they had the same thinking when it came to renewing their drivers license. They even posted “ I was driving with an expired license “, you receive a reminder in the mail when it’s coming up for renewal.

Actually I knew my driving license was expired. It was expired in 2013 and I got speed ticket in 2016 but I couldn’t go to the court to pay because I was scared. My relationship has been genuine I love my husband. All of our family members are supportive of our marriage. As I said I have all the photos, call details to prove my relation we have been living together and travelling with friends attending weddings to make our case strong and genuine so I can get PR. But I have been friends with a guy, we are both Indian,same culture and understanding. He lives in Canada he born here and know I am illegal here. He confessed his feeling and wants to marry me but I already applied for my PR with my husband and I am so confused because If i withdraw my application I will not get PR later so if I stay with my husband until I get Pr how long I have to stay in marriage w him so I don’t loose my PR status?

If you're already asking that, your marriage is a fraud.
No it’s not. Why would I stay with my husband for 4 years? People can change and develop feeling for other person. Should I withdraw my application ?but If I withdraw and how will I get Legal status here.

It's a fraud marriage if you are continuing with it to get status in Canada, which it pretty much sounds like you are doing.

You seem to have zero respect for the laws of Canada.
