Good Day,

I am seeking counsel on the best path forward in order to obtain a TVV for my boyfriend of 2 years. To date, we have been rejected three (3) times in our attempts over the last seven months. Each rejection has come with it's own reason as per the items below, and 2 of the three items have since been mitigated (resolved).

  • Rejection 1: insufficient funds - (mitigated)
  • Rejection 2: request for a letter from Vice Chancellor of University confirming his BA Degree was complete and his Dissertation was published as part of the degree requirement - (mitigated).
  • Rejection 3: requires strong ties to prove a return to his home country, - Land rights required.
We have since obtained legal counsel to which the lawyer was very honest and forthcoming - stating that our next re-application process will only guarantee a 50% success rate; even though 2 of the 3 rejection items have been met. We are presently working on obtaining the legal documents proving land rights; however, we need to ensure our best path forward is successful.

We have provided the following as part of our overall application: proof of degree and published dissertation, letters from Vice Chancellor of the University, letters from his completed 4 year internship, Owned Business registration and documentation, tax receipts, 6 month bank funds, total of funds in the account marked as "Canada Savings", Sponsorship letter proving that all Accommodations are accounted for (rent free, food and transportation), my sponsorship letter disclosing the background of our relationship, length of time, itinerary and methods of communication in the last 2 years, confirmation of members of my family and method of communication, and finally his previous travel to neighboring countries.

Is there anything we are missing? Help and honest guidance is welcome.

It has been suggested that perhaps we draft a proposal as opposed to assembling an Application. Thoughts?

Did your lawyer ever tell you that TRVs for applicants with Canadian SOs are often rejected?

It sounds like your partner is not employed but has his own business, which is also sometimes precarious because it can be abandoned.

I'm not sure what was the point in providing his dissertation.

Can you itemize what his ties to his home country would be?

Without knowing what it is, I also have a feeling his home country's status/general economic/political climate played a part.

how long does he plan on coming to visit you? is the plan to get married and for him to move here?
As Bellaluna says the seriousness of your relationship would actually work against you, as he is more likely to just stay with you and not go back.

How much of a bank balance is he showing? He needs to show that he can pay for the entire trip himself without relying on you or someone else. How long is he looking to visit?

Do not go into great detail on your relationship. Keep this very brief - what you've indicated above is way (way way way) overdoing it. If you provide that much information - IRCC will have concerns he is planning on remaining here long term.

Travel to other countries only matters if it's places like the US or UK that require a visa.

He plans to visit for 6 months. We made it clear that it’s to spend time with me, spend time with my family and our mutual friends.

6 months indicates his ties to his country are not necessarily strong, think you asked for too long of a visit.

Unfortunately he was asked in an interview in person to disclose countries he has visited outside his own. My boyfriend is African and the process is very complex. He has $6,000 for the duration of 6 months not including money set aside for his air fare, medical insurance.

As earlier explained - his stay here will be fully 100% accounted for with accommodations such as food, transport and rent free apartment. So he has more than enough to Sustain him.

He should have enough funds of his own as well. What happens if you get into a fight? You are not legally required to pay for him and then $6000 would not last 6 months. Then could he be a burden to Canada?

Also applying so many times in such a short period of time could indicate a desperation to come to Canada.

It's fine to disclose everywhere he has traveled. However the only countries that will "count" for IRCC are those requiring visas.

Six months is far too long a visit. If he asks for this again - refusal is guaranteed. A six month visit shows he has absolutely no real ties to his home country. He should be asking for 2-3 weeks tops given his previous refusals and weak ties.

Doesn't matter that you are covering everything while he is here. Again, IRCC expect him to have sufficient funds to cover everything himself.
