We applied outland in June
my hunsband got approved as a sponsor end of august and i got biometric letter so I'm flying out to my home country to do that with passport renewal i know i can go to usa to do biometrics but we planned me flying to my homecountry to do that in order to see my ill father as well

While me and my husband were looking into eta applications we noticed theres arrest history
Of course we are going to write truthfully on eta applications
It is very shamful to tell but 2008 while i was in canada on student visa i was arrested with shoplifting no conviction no charge but i did letters and volunteer work . lawyers letter says since charge was never entered (i dont know what that means ) no criminal records . then it got us reminded about pr applications and honestly we thought it was asking any other country than canada so i said no to arrest we knew i will be going thru rcmp background check and everything and they would know
so didnt think question was includs canada......im done ...arent i ....im shaking and thinking this time i leave for biometrics could be the last time i would ever see my husband in here canada ...should i call cic to explain or should i just upload detailed explain on web form anyways ...

This is a pretty big issue - you have committed misrepresentation by not being fully honest on your sponsorship form. Yes, they will catch it in the RCMP background check, but that doesn't mean that you can just neglect to tell them about it on the form.

The worst part is, your offence was so long ago, and pretty minor. If you had just been honest, you would have been deemed rehabilitated and there would have been no issue. Now, though, it has become an issue.

I would recommend you immediately upload a detailed explanation using the webform. Explain that you made a mistake and that you are anyway deemed rehabilitated. Upload all the letters and documentation you have from back then, showing how minor the offence was, and how you were never charged.

In fact, you may not even be inadmissible on this basis if you were never charged and may not even need deemed rehabilitation. You just needed to tell them you were arrested and then explained the circumstances.

Also consider talking to a lawyer. Your offence was very minor (based on what you're telling us), so it's just the misrepresentation that you have to worry about.

Thank you so much for taking time to read and reply....we will try whatever takes ....but how stupid im ....i just cant forgive myself for all these . i can only pray they consider this as unintended mistake ....but i know its my fault ...

All i have is lawyers letter saying that i have not been charged and convicted ...also saying my case was sent to diversion prior to charge being entered or a coirt appearance ...theres no court file pertaining to my offence ..... I will upload this first . can i also scan and upload written letter of explanation ?thank you

While it could be serious, it’s important to correct the error before IRCC finds and inquires about it. It’s generally not seen as misrepresentation if you disclose prior to IRCC finding and digging into it.

i dont have any papers from court or police but lawyer stating ive done what was asked and this concludes the matter completely . sorry to ask again but can i write a letter and scan and upload as well with this .never done web form so wondering how mamy papers i can upload and thank you again for replies i hope i can update you all with good news
