Apply for refugee claim after withdrawing case

I am a married lady. Let me ask you a question legally. Can I apply for immigration to Canada as a refugee by private sponsorship. Sponsorship Agreement Holders or Groups of Five (G5)


let me explain to you. my Husband was in Canada and he was applied for refugee Claim inside Canada. But he withdraw his case and he left Canada. Because my life and my children at our country was in real danger. Because there are gangs who pose a threat to our lives. I'd like to tell you a few days ago someone attacked us inside the house at night. Surely if we were at home at the time of the attack he would have killed us. Luckily we were not at home during the time of the attack on our house. When I returned home I found that an attack had taken place on my house.

All the special jewelry has been stolen with the amount of money and I filed a complaint against people who stole jewelry and money. and I have a official papers from the police station and the court. So question is: can I apply for private sponsorship to immigrate to Canada? excuse me I want to know is My husband's previous refugee claim case affects my application. or his case is separate and does not affect my application. I hope you answer my question. Because I desperately need the help you have to clarify this question.

Group of Five won't be possible since you must already be recognized as a refugee by UNHCR to qualfiy. You cannot be recognized while in your home country. You would have to leave your home country and move elsewhere - and be recognized by UNHCR there.

Sponsorship Agreement Holder is possible - but it tends to be very difficult these days to find a sponsoring organization.

We are not at our country. And we are will apply in UNHCR as soon. and we have many persons who’s will be ready to Sponsor us. Only my question is: I’m as a lady can I apply for immigrate to Canada by private sponsorship ( G5 $ after I get the prove from UNHCR. What I fear is that my husband applied for asylum in Canada, but before the hearing of his case, my husband withdrew his application .. Does his previous application affect my case when I make a special bail. Thank you

Yes a recent withdrawal of your husband can affact your claim.
With what you have stated I do not see any basis for a refugee claims there:
1. Higher criminality is not regarded as a valid refugee claim. Many countries do have high criminality or gangs problems, even in developed countries. This is a matter of police.
2. Being robbed as sad as it is is not a ground to claim refuge. It can happen to you even in countries like USA or Germany. So filling a police claim is a proper way to do.
3. It is not that easy or fast to be accepted as a refugee by UNHCR (it can take some time). You also need to count that in the other country you might have to live somewhere while waiting. It takes also lot of time for group of 5 (2-5 years) to be approved.


From what I have seen so far in your post I do not see any refugee grounds. Best way to deal with it is what you are already doing (police claim, count your loses and continue to live). You have almost always option to relocate with your country. So did you try that one?

Thank you very much for your helpful feedback. In fact, the government or police in my country do not enforce the law fairly. Because there are crimes happening the government is the main actor or accused. I can say that the implementation of the law is only implemented against the poor and opponents against the policy of the ruling party.

For example, my husband works as a government employee during a period when my husband discovered that his manager was stealing large amounts of public money from the state. When my husband informed the competent authorities about the theft of his manager. Neither the police nor the government arrested the robber. However, the manager knew that it was my husband who reported against him .So the manager threatened my husband with death and kidnapping because the manager belongs to the ruling party. There are cases and crimes committed by government gangs who assassinate people opposed to government policy, these crimes are published by the media and there are reports from the United Nations on crimes in our country. That's why I'm worried about staying in my country
