Can I update spouse accompanying to YES after receiving OINP nomination

Hi Everyone,

I have created EE profile with spouse accompanying to NO to have better CRS score. I have received Ontario PNP invitation and nomination. Now I have additional 600 points. Can I update EE profile with Spouse Accompanying to YES. Will it create any issues as my original CRS(excluding 600 points) will be decreased and it would be less than the Ontario invitation draw score..

Thanks for your inputs in advance.

I saw a few posts on this site which stated that they did like this and got accepted. I want to get to the bottom of this with remarks from people with first hand experience

Yes this is perfectly legal and works great! I am through by doing the same. Oinp does not take any info from express entry system. It has a separate portal to access candidates. You will be asked the same question in your oino whether your spouse want to accompany you. Say yes there despite whatever you have put in your express entry profile doesnot matter this is separate. When the processing finishes and you receive 600 points, edit express entry profile to say spouse accompanying and there you are!

Hope it helps

Thanks for the great info @Ammarhaider22. Would you mind sharing if you have completely got PR with this approach? I still have some concerns though. Can you please advise?
1. How come OINP does not take any info from EE system? Without info from EE system, how would they check for discrepancies between EE profile and OINP application, and validate our CRS score?
2. Would IRCC question the change in EE profile? Although we can make any changes pre-ITA, I've read somewhere that change logs will be captured and VO will take a look at the previous versions of the profile.
3. Would IRCC recalculate CRS point with accompanying spouse and compare with the cut-off score of the OINP draw (not the federal draw)? With spouse accompanying, the CRS score might have fallen below the cut-off.
4. If this approach is legal and accepted, when would be the best time to make the profile change: (a) before submitting OINP application, or (b) after submitting OINP application be before receiving Nomination, or (c) after receiving Nomination?

I have done the exact same thing and got PPR in the shortest time i.e. less than 2 months. I have got visa stamped and ready to fly.
1. How come OINP does not take any info from EE system? Without info from EE system, how would they check for discrepancies between EE profile and OINP application, and validate our CRS score?
They don't. I do not know the details but they don't as the lady on oinp helpline told me.
2. Would IRCC question the change in EE profile? Although we can make any changes pre-ITA, I've read somewhere that change logs will be captured and VO will take a look at the previous versions of the profile.
Make as much change before ITA as possible. no need to worry about anything. It does not impact your case negatively. Don't confuse yourself with rumours.
3. Would IRCC recalculate CRS point with accompanying spouse and compare with the cut-off score of the OINP draw (not the federal draw)? With spouse accompanying, the CRS score might have fallen below the cut-off.
After you receive nomination? Nops. They will recalculate but with 600 points so yours will still be above 1000. its pretty straightforward. Your case does not get rejected just because with accompanying spouse you get below cutoff. The point is that province wants you, and they are willing to give 600 points to you. Now if you want your family to accompany you great they have no issues.
4. If this approach is legal and accepted, when would be the best time to make the profile change: (a) before submitting OINP application, or (b) after submitting OINP application be before receiving Nomination, or (c) after receiving Nomination?
I did B. Just before receiving nomination, i changed to spouse accompanying and lost some points but when I got nomination and accepted it, I got ITA in next draw. I also added an explanation while submitting PR application in EE that my points were less so I selected spouse not accompanying but I got nomination thus added spouse accompanying.

Make sure to add spouse accompanying in OINP application as EE verifies the family members are added in pnp if you select spouse accompanying later in EE. If not, you have to ask OINP to add them as additional request.

Thank you so much. This is a very inspiring success that brings hope to others people like me. I'll summarize the exact steps you did, together with some more questions below. Hope that you can help and please correct if I assume something wrong.

(Before that, my case: NOC 2174. CRS with spouse accompanying: 440. CRS with spouse non-accompanying: 453)

1. Created EE profile with spouse non-accompanying to have N points (which is higher than A points if spouse accompanying).

2. Got a NOI when OINP draw happend with cut-off score C:
Could you please share your scores N (spouse non-accompanying), A (spouse accompanying) and C (cut-off score of that OINP round). The reason I'm asking this is that I'd like to see if your A is less that C and how much less, to compare with my case. OINP might have been ok with your A because it was not much less than C, but might reject me if my A (440) is significantly less than C (for example 448).

3. Submitted an application to OINP, with spouse accompanying:
a. Did you explain to OINP that your EE profile had been having spouse non-accompanying?
b. Did you admit to them that your CRS score if adding spouse would have been A, which was less that C (cut-off)?
c. Did you put those explanations in the LOE or in separate email sent to OINP, or both?
d. Did they response anything, or just quietly accept it and nominate?
e. Could you please share with me (alessio2110@yahoo.com) or with us here the writing part that you explain this to OINP? Thank you so much.

4. Before taking the nomination, updated EE profile to have spouse accompanying:
a. Did you update the profile after you got the nomination but before accepting it, or even before getting the nomination? If the latter (not received the nomination yet), how to know that OINP had been ok with your spouse, to safely update EE profile?
b. After updating EE Profile, did you notify OINP? if yes, did you do so by email?

5. After getting an ITA, submitted eAPR:
a. Did you admit/explain to IRCC everything, including the scores A, N, and C and the real reason for having non-accompanying at first then changing to accompanying later?
b. Could you please share the writing part that you explain this to IRCC?

So many and long questions, but I hope that you will help, Thank you so much again, @Ammarhaider22.

N =444
A =402
C =439

3a= Nops. Not explained anything to OINP but before submission of profile I crosschecked with OINP through email as well as helpline and they said its okay no issues.
3b= Nops I didnt fee the need to explain anything.
3c= No explanation to OINP
3d= They quitely processed and nominated. Just I was asked for additional document request that my bank statement was missing the currency type field. I had to submit that again thats it.
3e= Nothing explained.

4a= Even before getting nominated. I knew that because of statuses of OINP and Now I have got to know that OINP does not make an issue of your family. they just want you badly and thats why they are giving you 600 points and they are going to fulfil your request to add your family too. its not an issue at all.

4b= nothing notifying to oinp after updating ee profile.

5a= No I did not explain ANY THING to EE at all about all this. I thought I did but I dont see any letter of explanation in my documents regarding this matter that means I did not submit anything although i though I would.

@alessio2110 I have the same dilemma. I have received and accepted nomination but still I have some time to invitation in the next round. What you suggest?
did you changed spouse non-accompanying to accompanying?
What did you opted for? I'd appreciate your reply and advice.

I haven't got NOI yet. Still the the stage of deciding whether to have my wife accompanying or not. Looks like it would be fine to do this. Hope you will make it and share the result with us.

I'm still undecided, but I've asked Ontario regarding the same issue, and their reply is as below;

Dear Madam/Sir,

Thank you for your email correspondence to the Ontario Immigrant Nominee Program (OINP) mailbox.

Please be advised that only the applicant’s name appears on the OINP Confirmation of Nomination document.

Successful nominees must submit an application for permanent residence to IRCC within six (6) months of being nominated by the OINP. You must include a copy of your Letter of Nomination and a copy of the OINP Confirmation of Nomination document. You can also include your spouse and dependents in your application for permanent residence.

Please note that nomination by OINP does not guarantee the approval of your application for permanent residence by IRCC.

We hope this information will assist you. Once again, thank you for your email and for your interest in the Ontario Immigrant Nominee Program.
