Peace Bond and Imprisonment - effects on citizenship application

Hi all,

I have a question for those who have ever experienced legal issues while applying for Canadian citizenship.

The issue: My friend was arrested last summer and spent a few days in jail awaiting bail. He was granted bail and has been out ever since. He is not going to trial - he will be out on a Peace Bond (meaning he needs to be on good behaviour and not be charged with any criminal offence for an entire year). From a CIC stand point, how does this affect his citizenship application?

Question 1: Will a peace bond prevent (or delay) him from applying for citizenship? Legally he has not been charged with a criminal offence. Will he need to wait until the bond is no longer into effect before applying?

Question 2: He was in jail for a week while awaiting bail, but was released. From a criminal point of view he does not fall under the clause of "having served a term of imprisonment" (only had he been denied bail would this apply). But for immigration purposes does he need to mention that he was imprisoned on his CIC application?

He will be calling CIC, but it is always good to get feedback from others who may have gone through a similar situation.

In my layman's opinion I would suggest that your friend should consult an Immigration lawyer (LAWYER NOT CONSULTANT) who will look at the specifics of your friend's case and figure the best way forward.

I had a friend who was in similar situation, he never spent any time in jail but was charged for assault and came out with peace bonding. All this incident happened after he sent his application. Once he got the peace bonding discharge from the court he sent all the documents to CIC and he got his citizenship within the mandated one year period. I believe your friend can go ahead and apply now for citizenship if he agreed for peace bonding.

Can a peace bond be denied? I have a case where his wife have put several charges of assault, mischief, assault with a weapon, intimidation and wrongful confinement. His citizenship application is in process. He has clean criminal history. Assault charges are historic, exaggerated and false because wife continued to live with him for 3 next year and she is now pressing charges. Will he get a peace bond? His lawyer says that until his first court date disclosure is not available and hence nothing can be said.

Sure - a peace bond could be issued. Could go either way.

The fact the wife continued to live with him for 3 years doesn't really help his case or prove anything. It's very well know that victims often continue to live with their abusers and have trouble getting themselves out of the abuse cycle.

Do upfront counseling increase chances of getting a peace bond? Please suggest some counseling centers in Ontario and specific program name if you have one. Thanks.
