There is in fact a minimum. It's three years from the time your first spouse landed and became a PR. This is the period of financial responsibility. No - the five year rule does not apply to this scenario. The five year rule would only apply if OP had been the applicant in the first sponsorship application. However OP was the sponsor and looking to sponsor again. So the three year financial obligation rule applies.I believe the following would apply would it not? You may not be eligible to sponsor your spouse, partner if you:
- were sponsored by a spouse or partner and you became a permanent resident less than 5 years ago
- are still financially responsible for a previous spouse or partner that you sponsored. This means you’re still bound by the 3 year undertaking to take care of this person
How are you common law if he is living in the US?Can he come as a refugee to enter in the country and if the refugee doesn’t go through I can sponsor him?As my fiancé were common-law?
