I moved back to Canada in August 2018 with PR card expired in 2011, seven years after it was expired. I had two son's with me of 20 and 21 years old with expired PR cards since 2016.
The CBSA agent at the Border gave me some hard time asking questions and went inside for 10 minutes. He came back and handed me back our passports and said we are free to go. When I asked him what is the next step he said just go I will write my report to downtown office and they know what to do.
It's been now 9 months and I haven't heard anything from anybody knowing that I haven't signed any papers at the border.
Do you think we were reported? or he has just let us in? Is it risky to apply for assurance maladie or if I show up or change my address it will be reported to immigration?

I live and work now in Montreal.

Did IRCC have your current address? It sounds like the CBSA officer wrote a report, and usually IRCC then will revoke your PR.

There are three possibilities

1. The CBSA officer didn't, in fact, write a report. If this is the case, you are lucky and just need to spend 2 years in Canada to get back in compliance with your RO

2. The CBSA officer did write a report, but his superior officer decided not to continue the process of revocation. Again, you are lucky and just need to spend 2 years to get back in compliance.

3. The CBSA officer reported you, and IRCC did revoke your PR. They attempted to get in touch with you but didn't have your most recent address so you never knew they contacted you. If this is the case, then by now your PR has been revoked and you are living without proper status in Canada.

Agree with the above.

Knowing you were not in compliance of RO, you should have updated your address. Contact them ASAP, if your status has been revoked, this means you have been working illegally and will get in more trouble by turning a blind eye. It will catch up with you and your children, better to face it head on.

Hopefully, it is either 1 or 2 though.

You need to update your address and find out your status. The longer you go without doing that the worse trouble you are in if it is 3.

What do you mean "put you in the spotlight"? You can't really hide from this and expect it to just magically go away! If they're revoked your PR, it WILL catch up with you eventually, and you will be deported. Your sons, too.

You need to find out ASAP whether you're still a PR. If you are, there's nothing to worry about. If you aren't, then you need to take steps to not be living without status in Canada.

You do realize that if the officer wrote the report, IRCC has most probably already revoked his PR?

Still, I guess it's up to OP. If he wants to spend the rest of his time in Canada living under the radar, always worrying about PR status, never traveling abroad again, worrying about healthcare, worrying about taxes, worrying about applying for any government programs .. sure, go ahead.

I wouldn't want to live like that, but each to his own.

What's worse would be to spend years worrying and hiding and then find out that there was no need to worry because you were never reported in the first place.

It is impossible to know if OP was not reported because OP has not updated theiraddress. IRCC could have been attempting to tell OP that their status was revoked and how to make appeals but since OP had not updated address, the notices never made it to them. They do not know, and there is no way to know.

Continuing without knowing does not mean that OP can be quiet for a few years and all troubles will go away. Eventually CRA will find out that the SIN attached to her tax records is connected to someone with an outstanding deportation order. Or something else. The connection will be made. And the consequences will be worse.

Updating OP's address would let her know one of two options - that OP was not reported and status not revoked, or that OP was and it was revoked. Being quiet just makes the illegal overstay worse.

Agree with 21Goose and k.h.p.

If OP also successfully gets provincial health insurance based on a possibly revoked PR, they can all be in the hook for ALL medical costs incurred under it.

If the OP faces the music now, showing integrity does really well with judges who may be hearing an appeal should number 3 have been what happened and should she be allowed to appeal based on not getting the notice. Honesty goes a reaaaaaally long way.

Thank you all for all the input.
I haven't updated my address since I wanted to avoid any investigation, and wanted to be quite for two years.
I had an address here and the condo is rented and the post is directed to a relative of mine; this might minimize the risk of been contacted. hopefully.
Because of what have been said above, and to live in peace I will contact them early next week and check my status.
