Refugee protection rejected. Will this effect visitor visa?

Hi there,

My mother 71 years old was here in visitor visa, when situation changed back home and we had to apply for refugee for her to be able to keep her safe here. But we did not seek any welfare or government support during her stay here in the last 11 years. Me and my family financial supported for her care here with us, including medical.

Her file was recently finally opened and hearing was done, but since the country situation changed and now it’s no longer considered a risk, her application was rejected and she has been requested to leave the country.

Can I apply for a visitor visa for her from here? Will she be Rejected? What are my other options?

Chances of her getting another temporary resident visa are practically zero.

Which country is she from? India?

There are no other options for her to visit right now. Given her refugee claim and 11 year stay, she has no chance of being approved for any form of temporary residency anytime soon.

Assuming you are a Canadian citizen or PR, you should look at trying for a spot in the PGP lottery to sponsor her.

The fact that she applied for asylum + stayed for 11 years will work against an approval for any temporary resident visa.

She is also not at an age where she can re-establish her ties to Srilanka and reapply for a TRV/super visa after a few years (Read: Employment, finances, family - most family members seem to be in Canada, etc).

The mere perception of risk to one's life does not give reasons to claim asylum. Your mom could have moved to another part of Srilanka

Zero chance of a super visa. A refusal would not affect a future sponsorship app.

Our imigration system is slow but you must not have claimed asylum 11 years ago and only recently been refused. Did you appeal?
