Sponsoring Minor Children

Hello All,

My wife and I along with our oldest daughter became PR in 2003. After staying for few years and moving between Canada and US we moved to US. Later we had two more daughters in US. Three years ago my wife permanently moved back to Canada along with the three daughters. She also got her and oldest daughter PR renewed since she is working and living her and met the residency obligation.

Now the question, we would like to sponsor our two minor daughters, 6 and 10 years old, through my wife. She has a decent job and should not have any problem supporting them. I have made sure that my daughters never over stay and have always crossed the border to US before 6 months. Is there any issue if my wife sponsor the two minor children for the PR? Does anyone see any complication here? We plan to file for them in Canada since they are here with the mother. Please advise. I spoke to one lawyer and she said my case is complicated and she would have to be very cautious how she presents it. Another lawyer said, it is straight forward since my wife has renewed her PR and permanently lives in Canada and has a life here. Any suggestions?

Provided your wife meets the residency obligation, there won't be any issues. It's a very straight forward case.

Yes she meets the obligation, has been living in Canada since last three years and this year got the PR renewed in Feb. In fact she is due citizenship, but want to apply for it along with the two daughters after they get the PR too.

Also note that living in Canada is sometimes misunderstood as simply having the main residence here.

Residency and citizenship requirements means physically living here and not just having a permanent residence here. I would assume your wife and children has gone to visit you in the US within the last 3 years? For how long each visit and how many visits? You would need to take off the days your wife is physically in the US from what you count towards her residency/citizenship. But if she just got her card renewed, I assume she has at least spent 730 days here and should be fine.
