Hello,

I am going to apply for Canadian study permit to do the MA at UBC. My wife and daughter would like to accompany me in Canada.

My daughter will apply for Open Study Permit. While filling out my daughter’s Open Study Permit using form IMM 1294 (Study Permit Made Outside of Canada), I have noticed in ‘Details of Intended Study in Canada’ section of the form, the following information is required (Q#1-4) : full name of the school or institution, level of study, field of study, (DLI) number, expected duration of program of study, cost of studies etc.

But so far I know to apply for Open Study Permit no offer letter is required. In other words, it’s not possible for the applicant to provide with the aforementioned information. However, without the aforementioned information form IMM 1294 cannot be validated.

Please suggest how to overcome such a barrier.

Best regards,

Rokaarlmu

I think I read the first link wrong it is only for those children already in Canada that don't need a study permit. So you were correct.

https://www.canada.ca/en/immigration-refugees-citizenship/services/study-canada/study-permit/prepare/minor-children.html
Minor children who want to study for six months or more must apply for a study permit before they enter Canada. This includes minor children who come with parents who had a study or work permit approved overseas.

You do not need a study permit for a program of six months or less, but you may still apply for one before entering Canada.

If you are coming to Canada with parents who have a valid study or work permit, you don’t need to provide a letter of acceptance from a school when you apply for a study permit.
Who is a minor child
Each province and territory decides the age when a person becomes an adult. This is known as the age of majority. A person under the age of majority is a “minor child”.

Province or territory
Alberta, Manitoba, Ontario, Prince Edward Island, Quebec, Saskatchewan = 18 Years
British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Yukon = 19 Years
So it seems they do need study permits but they don't need Letter of Acceptance.
But the problem remains that you cant fill that stupid form without filling in the School details, so I'm stumped. Are you doing paper application? Maybe consider going to the VFS and see if they can guide you.
Because I actually tried just now doing an online application with a minor family member and it lists LOA as a required document you have to provide which is wrong.

Hi LOA is not necessary to apply for ur minor children. Uf the system asked u just answered YES and when it will require you yo submit a copy in the main application portal just attached a letter of explanation that based on IRCC ( qoute the msg from their website) they dont need a LOA. As for the main application form for student visa, indicate “ to be determined” under the school information.

I am also filling a study permit for kids accompanying Father on Work Permit.
What to fill in expected cost of education ? I need to enter some numbers ?
And filling Not Applicable in other study fields is acceptable ?

A side question, is there a dependent spouse visa for WP applicant or is that regular Visitor Visa which is granted ?

Hi msmuffet, did you manage to do that before? I have a similar case and when I contact the migration department of Consulate General of Canada in Hong Kong, I got the following answer, so I am not sure what I should do now:

While you may not be required to provide a letter of acceptance while applying for a study permit for your daughter to accompany you to Canada, you are required to provide information on the school that she will be attending.

If you have not yet made these arrangements for your child, you must do so before applying for the study permit. As indicated in our previous response, you must contact a district school board where you will be residing to obtain a placement for your child and detailed information on the cost of tuition.

Regarding your last comment, as per Canada’s immigration laws, you cannot apply for a study permit after your child arrives in Canada. Foreign nationals intending to study in Canada must obtain a study permit before entering Canada.

Immigration and Refugee Protection Act

DIVISION 1 Requirements and Selection

Requirements

Application before entering Canada

11 (1) A foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or document may be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act.

Immigration and Refugee Protection Regulations

Study permit

9 (1) A foreign national may not enter Canada to study without first obtaining a study permit.
