URGENT! Working obtained while on Business Development Trip in Europe + Vacation

Hey there guys,

I got a concern right now as I don't know what to do some links and forums say different than others.

I started my Job in March 1st for a Technological Company as a technical sales representative. During this period I went for 2 trade missions to Europe totaling appx 4 months of the year. My employer is willing to give me letters confirming it and I was paid as well during this time.

Example: I left Canada October 29th I did extensive traveling all over Europe entire November and in December I was working from home and took a vacation over the Christmas 22nd Dec- 2nd January 2019 on 4th I came back to Canada and since then I am gathering my documents to apply for PR under CEC.

Does this all count toward the 1-year minimum??

Furthermore, if I went for 10 days vacation in the summer to the U.S is there anything that makes trouble for the 1 year under CEC ?

Please reply I am applying in 3 weeks.

Not sure if the overseas work trips will qualify. Suggest you ask a senior e.g. jes_ON
You mention a total of 4 months but only detail one period of late oct through dec which is a little over 2 months. If you elaborate on the dates it might help someone answer.
When you say you are applying in 3 weeks do you mean enter an EE profile or have you already done that and had an ITA? If so when did you get your ITA?

Re: The 10 day vacation is that 10 working days or 10days in total? - Up to two weeks vacation in any 12 months will be OK.

For future reference... there are 2 stages in the process and it helps to use the right terminology.

First stage - submit an "expression of interest" profile. This is just a profile, not an "application." If you say you are "applying" when you mean submitting a profile, you will confuse everyone and could even get wrong advice.

Second stage - after you have submitted your profile, if you have enough points, you will get an Invitation to Apply (ITA). This is the application stage. When you apply, you submit an electronic application for permanent residence (eAPR).

Just to clarify, 2 weeks is a "minimum" amount of vacation that people can claim. Many salaried employees will have more vacation (e.g. 3 or 4 weeks). This is part of a remuneration package (AKA benefits) that should be mentioned in the reference letter (esp if you want more than 2 weeks considered as "vacation"). IRCC merely says a "reasonable" amount will be accepted.

Hey Jes, The vacation doesn't matter really... what matters is if the time outside Canada for business development purposes can count toward my work experience 1 year

The (paid) vacation time is not a problem, but if you have more than 2 weeks of paid vacation, this should be listed in your letter of reference as part of your remuneration, along with other benefits. (You cannot count unpaid leave of absence, however).

As for your business trips - recently, IRCC appears to be counting business trips as "employment" (this has not always been the case), but your travel is so extensive , and the "working from home" outside of Canada is particularly iffy and not likely to count. I think your case would fall into the "case-by-case" situation, so no one will be able to give you a definitive answer. That is 1/3 of your one year of qualifying experience, so IRCC might have to think hard about that.

You have 2 options.
You can wait until after you worked longer in Canada, and then apply without worry. OR,
You can submit your profile in March and proceed, and see what happens. If it is not approved, you can always reapply, and by that time you would have more 'in Canada' work experience (assuming you don't spend the next 4 months in Europe as well : ) )
