Hello, I'd be very grateful if you could answer a few questions regarding salary certificate. First of all, can salary certificate be issued to an ex-employee? If yes, here's my situation: I worked for a small establishment for 4 years, I took 2 unpaid leaves/vacations and was paid in cash for the entire period of my employment. I was given 1 wage hike after 2 years of employment. I want to upload a salary certificate and my former employer is willing to sign & stamp any document as long as it states the truth, what are your suggestions? Thanks in advance.
You can surely get a salary certificate, for that matter even a reference letter will be enough. However, even if your took cash, you much have paid taxes on that, so you can include IT returns. Also, your employer mush have had books, and you can get the copies of the for your records.

Hello LegalFalcon, thank you for your insight into everyone's questions. I'll ask one today as well :)

I joined my company X as an oilfield engineer in NOV 2014. The company merged with another company Y in Jan 2017 to form a new company XY.
The merger hasn't affected my work responsibilities but it did eventually result in a change of my job title only. I'm in the process of drafting the reference letter which I'll handover to my company to use as a template some day. However, my questions are as follows:

1) Is it OK if I make a single reference letter for the entire duration (and thus a single entry in EE work history with the existing company name and job title) and just mention in the letter that the company XY was formed after merger of X and Y and that it didn't have any effect on my job responsibilities of the employee other than change in job titles?

2) Do I need to attach any supporting documents to cover all bases? such as a newspaper clipping listing the merger or my appointment letter with company X that I originally joined. I do have additional documents such as promotion letter, pay slips etc but people have said that if you have a reference letter following the criteria then it will suffice.

2) No. That is not required. IRCC only asks for a reference letter. However, if you work for a company that has no visibility on the internet, you can then add payslips, tax returns etc to support your case. But there is no need to include documents of the merger. If you thing that you should include the merger documents, then you should include the company filings, i.e. the documents filed with the securities and exchange commission or the equivalent in your country of residence.

If your spouse is not the primary applicant, she gets no points for her foreign work experience. So for the work experience, you can simply say no and move ahead. However, you will have to mention all this in personal details, but nothing in work history. If you answer no, you will also not be asked to upload work reference letters for your spouse.

You can change your application post ITA as long as you it doe snot affect your CRS socore. Since you never got any points for your spouse's work ex, it won't matter.

Further, misrepresentation happens only when you do not disclose a MATERIAL fact or alter a MATERIAL fact. Since you do not get points for your spouse's work ex, it is not material.

Yes. You should. Ideally, you can just submit an updated work reference letter with the new letter head.

I have read on this forum that they compare previous applications with new one, so in my last application I show my education till graduation and hide my higher qualification, to get study permit for a college diploma, but my case was refused. Now I decided to apply again with new category as express entry /skilled immigration, in this application I need to show all my higher qualifications to get maximum point but I have a fear if I disclose my all qualifications they may refuse or issue PFL on this point that why I hide my higher qualification in previous application ?
So please guide me in this regard what I have to do?

You have to provide the essential details, i.e. the identity document (passport) for the profile. It is mandatory. If you do not have one, you should get it asap. If you fill in an application without it, you will need to file a LoE explaining why there is no passport along with all the details of you trying to get one (proof of filing). You will also need the child's passport for the medical.

Ok thanks, that is easy then. My company has a lot of visibility and in fact is based in Canada as well so I'll take your advice of not attaching any merger specific documents. I guess I'll just mention the date the merger happened and the before & after names of the companies in the reference letter and hope it should suffice.

If your prior application was refused, you do not have to worry much. Simply file your PR with all the correct facts.

You can simply state as home maker. If the work done is part-time and the proceeds of the employment are outside Canada, then you can even state online work. It won't matter either way.

It does not matter. For the dependent spouse's work experience outside Canada no points are awarded. Do't complicate things and just mention homemaker.
