HOW TO ADD A NEWBORN TO SPOUSAL SPONSORSHIP APPLICATION FOR PERMANENT RESIDENCY IN CANADA.

How you add a newborn to your spousal sponsorship application depends;


WHEN NEW BABY IS BORN INSIDE CANADA

A baby born inside Canada is likely a Canadian Citizen (….principle of jus soli) and not eligible to be sponsored or issued a visa.

.........exception: baby born in Canada to foreign representatives, diplomats or consular officers with both parents enjoying special status under the Foreign Missions and International Organizations Act (FMIOA).


To add your New Baby born inside Canada, you need to do the following;

1. Update IMM5406 - Additional Family Information form (Section B) and send though IRCC Web Form to IRCC.

Note:

a. Update IMM5406 form Section B with dependent child details as the Principal Applicant has a new child but is not been added to spousal sponsorship.

b. “How many Family Members, including you, are in this application” the Principal Applicant provided in IMM0008 Application Details Q3 will not change as your baby is a Canadian Citizen and not eligible to be sponsored or issued a visa.
2. Send a scanned copy of the newborn Canadian Birth Certificate through IRCC Web Form to Visa Office (to confirm baby birth).

3. Pay online the Canadian Citizenship Certificate Application Fee and apply for your newborn Canadian Citizenship certificate.

4. Send a scanned copy of the Citizenship Certificate Application Fee Receipt though Web Form to the IRCC Office processing the Spousal Sponsorship application.


WHEN NEW BABY IS BORN OUTSIDE CANADA

How you add a new baby born outside Canada to spousal sponsorship application depends on if the Sponsor is a CANADIAN CITIZEN or a PERMANENT RESIDENT (PR).​


A. IF THE SPONSOR BECAME A CANADIAN CITIZEN;

1. by Birth
2. by Naturalization

Your new baby born Outside Canada;

1. Has a claim to Canadian Citizenship and is a Canadian citizen
2. Is not eligible to be sponsored and cannot be issued a visa.
3. Cannot be added to your spousal Permanent Residency sponsorship application.
…...refer to IRCC IMM5533 checklist (SUPPORTING DOCUMENTS FOR SPONSOR section).​

To add your New Baby born outside Canada, you need to do the following;

1. Update IMM5406 - Additional Family Information form (Section B) and send though IRCC Web Form to Visa Office.

Note:

a. Update IMM5406 form Section B with dependent child details as the Principal Applicant has a new child but is not been added to spousal sponsorship.

b. Your baby is a Canadian Citizen and cannot be added to the spousal sponsorship.
Hence, “How many Family Members, including you, are in this application” the Principal Applicant provided in IMM0008 Application Details Q3 will not change, no Dependant is added and no update is required in IMM0008 form.
2. Send a scanned copy of newborn Birth Certificate issued by government authorities in the country where the child was born through IRCC Web Form to Visa Office (to confirm baby birth).

3. Pay online the Proof of Canadian Citizenship Application Fee for a minor (currently 75 CAD).

4. Send complete application for Proof of Canadian Citizenship for the newborn baby to the IRCC office responsible for the country where your new baby was born.

5. When available, send a scanned copy of the Acknowledgement of Receipt of application for Proof of Canadian Citizenship through IRCC Web Form to the Visa Office processing the Spousal Sponsorship as a proof of application for Canadian Citizenship for your newborn.

6. Later apply for the newborn Canadian Travel Passport.


B. IF THE SPONSOR IS A PERMANENT RESIDENT (PR) IN CANADA

OR
C. IF THE SPONSOR IS CANADIAN CITIZEN
  1. Born outside Canada to a Canadian parent AND the “Exception to the First Generation Limit”does not apply to the Sponsor AND your new baby was born outside Canada.
......Your newborn is a second generation born outside Canada and is not a Canadian Citizen.
Changes to Citizenship Rules - Exceptions to the first generation limit:
2. Who was Foreign born adopted by a Canadian parent, and became citizenship by
Grant AND your new baby was born outside Canada.

.....Your newborn is a second generation born outside Canada and is not a Canadian Citizen.
Changes to Citizenship and PR - Criteria for Adopted Children:

Note: If Sponsor was foreign born and adoptive parents sponsored you to immigrate to Canada as a Permanent Resident and later applied to become a Canadian citizen by naturalization……the first generation limit to citizenship rule won’t apply…and your new baby born outside Canada is a Canadian Citizen.
Citizenship law and adoption

Your new baby born outside Canada;

1. Is not a Canadian Citizenship.
2. Is eligible to be sponsored and issued permanent residency visa.
3. Should be added to your spouse Permanent Residency sponsorship application.
To add your New Baby born outside Canada, you need to do the following;

1. Update IMM5406 form (Section B) and send though IRCC Web Form to Visa Office (IRCC).

Note:

Update IMM5406 - Additional Family Information form Section B with dependent child details as the Principal Applicant has a new child.
2. Update IMM0008 form - Application Details Section Q3 – “How many Family Members, including you, are in this application”.

Note:

Your baby is a not a Canadian Citizen and should be added to the spousal sponsorship. Hence, “How many Family Members, including you, are in this application” the Principal Applicant provided in IMM0008 Application Details Q3 will increase (++) and the newborn is added as a Dependant.
3. Click on the “Add Dependant” button – update IMM0008 form with newborn details.

4. Validate and Send the updated IMM0008 form though IRCC Web Form to Visa Office (IRCC).

5. Send a scanned copy of newborn Birth Certificate issued by government authorities in the country where the child was born through IRCC Web Form to Visa Office (to confirm baby birth).

6. Pay online the Permanent Residency Application Fee for a dependent child (currently 150 CAD).

7. Send a scanned copy of the Receipt of payment for Permanent Residency Fee for a dependent child though Web Form to Visa Office processing the Spousal Sponsorship.

8. When available, send a scanned copy of the data page of the newborn International Travel Passport through IRCC Web Form to Visa Office processing the Spousal Sponsorship.

Successfully applied for my newborn abroad proof of Canadian Citizenship through embassy aboard.........took exactly 4 months to complete the process and obtain the proof of citizenship document.

if your wife spousal sponsorship application is in-process, you don't have to submit a separate new sponsorship application for the newborn Dependent.....you need to include the newborn to the in-process spousal sponsorship application, how depends on if you are a PR in Canada or a Canadian citizen.......so when your spouse PR visa is approved, both spouse and newborn will be issued PR visa.

What if my wife gets her visa before she gives birth? Do i send a NEW application? Given that hers is already done?

if your girl friend gets her visa before given birth.....and she has not landed as PR in Canada.....you will have to inform IRCC of the newborn as the PA is required to declare family members..... and you may add the newborn to the sponsorship, if you add the newborn, your girl friend will have to wait until the newborn is added and also issued PR visa like your girl friend before both mother and child land as PR......if newborn is not added, you will need to submit a new sponsorship for the newborn.....its very important that she informs IRCC of newborn if she gives birth before landing.

Hi, i have applied for spousal sponsorship on aug 2. And recently applied for add-on request for my new born in my ongoing process on 27th nov. And i have received a confirmation email too for the reception of the documents i sent to ircc.

My question is. How much time they will take to send me medical request for the new born?

Ps, status of my file is: recievd AOR, SA. m done with my medical and passed it. File is transferred to missisauga vo. My background check is in process...

medical for the newborn depends.....if the Sponsor is a citizen and the newborn is a citizen, no medical for newborn....if the Sponsor is a PR residing in Canada, newborn will examined as an accompanying dependent.....assume to complete process (PA PR and newborn added) takes 12 months.

How long does adding a newborn to the application get processed? My wife(PA) is due on february, how long will it take to add the newborn to her application.

I(sponsor) am a canadian citizen.

if the sponsor is a Canadian citizen....and the newborn is a Canadian citizen....you only update IMM5406 and it does not affect processing time.

application for proof of citizenship for newborn is a separate application and processing.

will advice you inform IRCC immediately baby is born as the applicant family composition has changed.

We are living in Canada. I’m working for more than a year in Canada . My wife is also living with me. For a reason we have to go to our country to born baby there. In that time I would be Canadian citizen and my wife is still permanent resident.
Assuming that I’m working in Canada, can I bring my new born baby in short period?
Is there any points that I should know before?

if the baby is born in Canada and the father is a Canadian citizen, does the baby also need a Canadian Citizenship Certificate?
Is the Canadian Birth Certificate not enough to proof Canadian Citizenship due to the exceptions of the jus soli law?
Is it necessary to send IRCC a copy of the Canadian Citizenship Certificate after receiving it?

Hi need urgent help. I had sponsored my wife in Oct 2019 however the application is still pending owing to Covid, meanwhile our son was born. I want to add him to application. Have sent mail via Webform to IRCC 3 times however they seem to be not reading any email and simply sending a generic reply saying "your application is under process".

Finally today I have received the following email from them

When you have a permanent residence application in process, a family member could be added at a later date, even if they were listed as a non-accompanying dependant in the initial application.

To add a person to your application, we invite you to complete the following forms and mail them to the Case Processing Centre in Edmonton, Alberta:

  • The add-on requestincluding:
    • your client ID number/UCI,
    • a detailed letter of explanation,
    • a copy of the birth certificate, marriage certificate or proof of common-law relationship, and
    • if applicable, the proof of payment.

Now I have following 2 confusions:

1. Everywhere people have mentioned on forums that they submitted their childs application via webform, whereas the email I received from IRCC talks about sending documents by physical mail. I hope the email IRCC has sent me is for adding a newborn to application is correct. OR should I send documents online.

2. When filling out IMM0008 I have to give Primary applicants detail again and then add my son as dependent in application? OR simply fill IMM0008 using my newborn's details.

Any help is appreciated,
