Applying citizenship with younger brother

Hello everyone,

I stayed in Canada for 10 years and I got my permanent residence around 3 years ago.
Myself and my younger brother (under 18) are eligible for applying Canadian citizenship but my parents are not.
So I'm wondering if I can be my brother's guardian or I can submit his application on behalf of my brother.
I would be appreciated if anyone has an idea.

I believe it's possible. Assuming your minor brother has satisfied the physical presence requirements on his own, then he should be able to apply for citizenship under Subsection 5(1).

And yes, your parents need not be Canadian citizens if they apply on his behalf under Subsection 5(1)

Any application made under subsection 5(1) of the Citizenship Act on behalf of a minor must be made by a person who has custody of the minor or who is empowered to act on their behalf by virtue of a court order or written agreement or by operation of law, unless otherwise ordered by a Court.

It is only in cases where the Minister waives this requirement that the minor can apply on their own behalf. The authorized person applying on behalf of the minor does not have to be a Canadian citizen.
