OWP Denied :(

Hey there,

I applied for an OWP (29th of August) from the Netherlands and my husband is a Canadian Citizen.

Today I received a message saying it got denied on the following grounds:

• You have not demonstrated that you come within the exceptions under section 186 of the IRPR exempting you from the requirement to obtain a work permit or that your employment in Canada comes within the exceptions to section 203 of the IRPR. As a result, your offer of employment must be the subject of an economic effect determination before a work permit can be issued to you. Your employer in Canada should contact the local office of the Department of Employment and Social Development Canada to begin this process.
• No evidence that you are married. No evidence that your spouse is a foreign worker or a foreign student in Canada.

I applied for a non-job specific OWP.
Does anyone know what this means and how to go about it?

Is your husband sponsoring you for PR? Obvious question, but did you include a marriage certificate etc with your application?

Hey! No, not yet. I just applied for the work permit because i need to able to travel. we will apply for spousal sponsorship in the future. I didnt include a marraige certificate - i didnt know I had to. I applied online and there wasnt a box to submit the marraige certificate.

Out of interest what justification did you include in your application to get a permit given just being married to a Canadian is on its own neither a justification for a work permit or residency. other than through spousal sponsorship, inland for the work permit.

You really should have applied for sponsorship. It states on the website that if your spouse was on a work permit or student you can apply for open work permit. It does not mention anything about a citizen, so I presume the only way is sponsorship.

I'm so sad..
Well your first mistake is not reading the guidelines for an OWP application. In order for you to be eligible for a OWP, you need to be:

1. Spouse of an international student in Canada. This does not apply to you
2. Spouse of an Foreigner work in Canada. This does not apply to you
3. Have applied for Spouse Sponsorship inside Canada. This does not apply to you since you are not in Canada and have not yet submit a PR Spousal application.

In other words, you have no basis to qualify for any work permit.

You were correctly refused. You don't qualify for an OWP simply by being married to a Canadian. Even if you provide proof you are married - the application would still be refused.

To qualify for a work permit, both you and your husband must be physically in Canada. He the needs to sponsor you for permanent residency as his spouse using the inland route and include an open work permit with the application. The OWP will be approved around four months after your complete application is submitted.

Yeah, will start inland when I get to Canada. Do u think they will stop me at the border though? Because of the denied owp..
