my wife is pregnant and lives in india and I am a PR in canada. Any1 knows how the medical will go?

1. what happens when the medical request comes for my wife, as she is pregnant and cant go for Xray? How much time is given to submit the medical?

2. Can the sponser/husband(with PR status) live outside canada (in india with wife) till the whole PR process gets completed? If no, for how much maximum time husband can stay outside canda (in India) when her wife's application is in process?

3. Is there any updation in the forms from june 2018 or july 2018?

1..When you receive the Medical Request......Book an appointment with a Panel Physician and the Physician will advice your wife......The Physician will perform the Medical Exam but may delay the X-ray........and the Physician may inform IRCC if the X-ray is delayed.

2. The sponsor could travel to outside Canada......but will advice you keep you stay outside Canada short......so it does not seem like you have move out of Canada permanently, which may cause problems.......PR to be eligible to Sponsor is required to reside in Canada.

3. not sure which form you mean......but for pregnant PA, there is question IMM5532E Q. #10.

If you have your newborn before the spousal sponsorship is completed.......you need to add your newborn to the spousal sponsorship application.

2) Only if the sponsor is a Canadian citizen. You may make short (couple of weeks) visits but you must otherwise reside in Canada. If IRCC believes that you have relocated to India, they will refuse the sponsorship aspect of the application under IRPR 130(1)(b)

  • 130 (1) Subject to subsections (2) and (3), a sponsor, for the purpose of sponsoring a foreign national who makes an application for a permanent resident visa as a member of the family class or an application to remain in Canada as a member of the spouse or common-law partner in Canada class under subsection 13(1) of the Act, must be a Canadian citizen or permanent resident who
    • (a) is at least 18 years of age;

    • (b) resides in Canada; and

    • (c) has filed a sponsorship application in respect of a member of the family class or the spouse or common-law partner in Canada class in accordance with section 10.
  • Marginal note:Sponsor not residing in Canada
    (2) A sponsor who is a Canadian citizen and does not reside in Canada may sponsor a foreign national who makes an application referred to in subsection (1) and is the sponsor’s spouse, common-law partner, conjugal partner or dependent child who has no dependent children, if the sponsor will reside in Canada when the foreign national becomes a permanent resident.

If baby is delivered before PR visa is issued ......you need to add newborn and may not cause delay in processing time.

If baby is delivered after PR visa is issued but before your wife land as PR in Canada ......you may ask to add newborn and this may cause a few months delay (depends on Visa Office) to issue new COPR and baby PR visa or apply for TRV to enable newborn accompany to Canada before sponsorship.

If baby is delivered outside Canada.....you need to sponsor your newborn.....and dependent child sponsorship takes 6 to 8months.

If the baby was born after she landed (in Canada) the baby would be Canadian...no need to sponsor.

Can we apply for Study Visa at the same time when the PR file is in process.. to be in canada asap?? Is is possible ?

You could try, but realistically IRCC will see she is being sponsored and reject the SV as an attempt to enter Canada early

Maybe I am missing it but what exactly is your question ? Could you maybe expand given doesn’t flow on from earlier posts.

This is a new question.

I have already applied for my wife's spousal sponsorship and her file/documents are received at Sydney office as we have applied for the outland applicant. We have mentioned in the document that she is pregnant but now her pregnancy is stopped due to miscarriage. So will this be an issue with the ongoing applied file process?? Do we need to intimate the officials for this or anything we need to do until they ask us?
Because during medical they may come to know this.
