Proof of legal status, work permit under AIPP

Hello,

Background:
I am in the process of immigrating through Canada under the Atlantic Immigration Pilot Program (AIPP). I am aware of all the necessary steps that need to be done and I will soon be getting a job offer and the company will thereafter be applying for endorsement, they will also ask for a temporary work permit while my PR is being processed.

However I have some concerns about applying for the work permit. In the document checklist, they mention proof of my immigration status in the country of residence (USA) if it different than the country of citizenship (India).
My status in USA is, my OPT has expired, I have applied for OPT Stem Extension and I have the following documents
1) Valid I-94
2) Valid F-1 Student Visa
3) Valid STEM Extension I20, valid till 2020
4) i797 receipt notice that my STEM extension is pending.

However, my stem extension case is still pending with USCIS, and the receipt notice date is actually after the expiry of my OPT i.e it will be considered late submission since my original timely filed application was rejected due to a clerical error and the resubmission was after the deadline. However I am still in legal status since my case is sill pending. The case will be pending for the next 2 months and I will be applying for the work permit before then..

Questions:
1) Will this impact my work permit if applied under the AIPP.
2) Will the documents I have listed be enough proof of my legal status in USA to the Canadian authorities ?
3) Is it better that I return to India and apply for the work permit from there to avoid issues ?

Ideally it would be best if I could apply from the USA, but I am very risk averse since this is my permanent immigration option, so I would like to avoid any potential issues.
Please advise.

Am I just over thinking this ? Should I just go ahead and apply since I have an application pending with USCIS ?
