I hope you understand the difference between visa and a extension of stay / amendment work petition application. It means you should not schedule a visa stamping or appear for stamping and attempt to return with a rejected stamping when you visit Canada using AVR.
Oh really I was planning to schedule a Visa appointment just in case I was not able to use AVR. that means it's a bad idea. please suggest .

I am not sure what more to explain or suggest than this. It has been written very clearly in CBP website.

somehow, I read it differently. Just trying to clear that confusion.

The person does not have a pending or rejected application for a new visa. - An extension and amendment should be part of this based on my understanding. That is the reason, I was planning to book a visa appointment just to safeguard myself, in case I had issues with AVR. But still confused.

Visa something that is meant for entering in to US. Work petitions are different from visa, and they don't come under visa. If you schedule for stamping or if you appear for stamping and get denied, then you are not eligible for AVR.

Thanks so much for your feedback. I get that if stamping is denied, then i am not eligible for AVR, but just scheduling (to be on safer side) also makes me ineligible - this I didnt know. Appreciate your help. but how sure are you about the scheduling part?

I am not sure fully too, but when in doubt better to avoid taking that route than risking in these things.

Why don't you attempt to re-enter using AVR first and schedule visa appointment with US Consulate in Canada only if you fail to return using AVR. Wouldn't that be safer approach though might be bit more time consuming?

Yeah, trying that now. But no appointments available for 3 months. So wanted to safeguard myself from that. Fingers crossed. Will update my experience next week.

Do take print out of AVR rules from CBP website and if any CBP agent troubles you then do not hesitate to ask for some senior CBP agent. Also keep this number handy ( CBP Customer Service - 1 (877) 227-5511)

Thanks, do keep us posted. I'll be using AVR as well in August when I have to go for landing. Your experience will be very helpful for others like myself.

We are planning to use ARV please suggest... our stamped visa has expired but have a valid i797 until 2020 also amendment has been filed for change of client which is under processing with USICS..
Planning to do landing process in Canada

1) after landing my family will return back next day ... will there be any issues with them using the ARV

2) I am planning to finish some base work and return back to US after 20 days would there be any problem if I enter using ARV

Hello,

There are plenty of posts explaining the AVR process via land travel. Can someone please share their AVR experience in detail who took a return flight. Planning to use AVR next month at YYZ airport, Toronto.

Any pointers will be most helpful.
