I am refugee claimant my family in USA for visit visa

Hi

My wife and daughter arrived in Buffalo city in USA. I am in Toronto, how I bring them here in Canada , my statu is refugees claim, they came to USA by visa my daughter USA citizen my wife not.

Please what I can do ?

So has your claim been approved? I believe, though not positive, that until your claim is accepted, your family can not claim the exception to the Safe Third Country Agreement, as you don't meet the criteria. Your daughters nationality may also be a problem, as US citizens are not generally accepted as refugees. Not sure how that would play out with her, but you should probably review possible options and issues you may encounter with a qualified immigration lawyer.

Not yet my hearing had delay . So you mean they will not allow my family enter to Canada, but my hearing it will after tow years , and my lower told that they can enter to Canada because I am already refugee claim .

I'm pretty sure that you need to have status first in Canada. Until they approve your claim, you technically don't have status, you are just a refugee applicant. Others may have a better grasp on it. Your daughter could enter as a visitor, but there is always a chance they will refuse her entry.

Because your daughter is a US citizen is it easier for her to enter Canada as a visitor. The problem will be encountered when your wife tries to enter Canada. If she requires a visa to visit, it is very likely she will be refused one based on your status here as a refugee claimant. Your daughter does not need a visa, however, because of your status again, she could be denied entry simply because they will assume that she will stay permanently.

You can not invite your family to come here to be with you. You will need to wait for your hearing, and if accepted include them as dependents on your application. I am sorry this is probably not what you wanted to hear, however, it is quite normal for the refugee stream of immigration. Best of luck to you and I do hope that you're able to see your wife and child sooner rather than later.

If they refused them because my status I will leave this country. I can’t wait for tow years for hearing and I don’t know although they accept my case or not, anyway there are many countries will accept me if they refuse mother and daughter three years old, I hope they don’t refuse them.

Do you have a work permit ? The reason I asked is because I was in the same situation (only it was me coming from USA)and I was allowed to make my claim at the Port of entry even though my wife was still a refugee claimant in Canada with no hearing date. I too was a little afraid that they would not let me reunite with my family but in the end I was allowed because she had a valid work permit. The officer stated in writing in one of the forms I was given. I hope that helps!

They are exempted from the safe third country agreement, meaning your family can claim refugee status at the border because you are "the husband" in Canada. Even if you are a refugee claimant with no hearing date. I am 100% sure.
