Starting express entry PR application, but spouse leaving the country!

Hey!

So I'm about to start my PR application, both me and my partner have lived and worked in BC for the last 18 months. I am on a closed work permit for a company and my partner has an open spousal work permit tied to mine.

Unfortunately due to an illness in the family my partner is having to return to the UK for the next 12 months. She will be returning to BC April (2019).

I will be the main applicant, so can I still proceed with the application process whilst she is out of the country?

If yes, are there any things that my partner will need to do whilst she is still in Canada (medical exam, police check)?

I've read around about different options to apply for a spouse through SCLPC or Family class, any guidance on this would be amazing.

Thanks for any help - I've tried contacting CIC, but can't even get a place in the waiting queue! :(

Your spouse or even you going out of the country does not have any affect on your PR. She can be in a different country than you. Few things that may need to be done. Medicals, she can complete her upfront medical in Canada if you have received your ITA. If not she can get it done in UK. No issue there. Secondly, since she will be in a different country once she is in UK she will have to apply for a new UK PCC for her. Rest all things should remain unchanged.

It all sounds promising. In regards to the police check, she will need a Canadian one as well as we've lived here for the last 18 months right?

IRCC will request Canadian PCC if they need to, sometimes they do it themselves without even asking you to submit one.

You do not need Canadian PCC unless explicitly requested by IRCC. They have internal checks to check your criminal history in Canada during the PR process.
