As a Spanish citizen, your child will be visa-exempt and can come to Canada as a visitor with you and your wife. You can then submit the sponsorship app. The biggest consideraton is that depending your intended province, your child may not have access to provincial health coverage while a visitor.

You can't include your child in you current app.
I really, really appreciate your answer.

I would only have one more question: if we go to Canada and begin the sponsorship, would the child be able to stay with us the whole time, or should he leave the country at any point?

For example, the eTA will be valid for 6 months, but if the sponsorship takes longer, I don't know if they child will be able to stay in Canada or not.

Your child can stay. The eTA has nothing to do with status. It simply allows a person to board a commercial carrier to travel to Canada. Your child will be granted visitor status by CBSA upon entry. Ask for a one year Visitor Record for your child and have the sponsorship app ready to show CBSA if they ask.

I wanted to share the below Scenario with you and expecting your guidance

Vivek is a recent Saskatchewan Provincial Nominated immigrant who applied for the PR from India for him, his spouse and 4 year old son, all landed in Canada as of July 2017. As he didn't had any job he decided to send back his family after a week.

He came to know that his spouse was pregnant when she returned back to India and now they have decided to give birth in India and the expected delivery date is second week of Feb 2018.

Question:

1) Vivek is now residing in Toronto and no Job, does he have to sponsor the new born kid or the Mom can do it back from India?

2) Should Vivek apply for TRV to bring the new born to Canada and then apply for sponsorship or the sponsorship should be first applied from India and then he have to apply for the TRV to bring the Kid to Canada?

3)I discussed the scenario with an Immigration Consultant and she advised that the new born kid can be added to the existing PR application and it would just take 4 weeks to process the PR, but I can't find those detail anywhere in IRCC.

4) Can vivek go back to India and apply for the sponsorship or he should be in Canada for the entire sponsor period till his family land back in Canada or do he have the option to fly to India and accompany them?

Could anyone suggestion the best possible solution

Nr 3 is not truth. Once you have landed you cannot add anybody to your PR application.
What you can do is to sponsort your child.
But you need to be in Canada in a first place.
If he wants to hold onto Canada best advice is to go for survival job and work on your profile in order to hit the wished type of job.

  1. He would have to sponsor the child. And he would need to remain in Canada while the application is in process.
  2. You could do either. Failing a TRV, you could try for a TRP. If that fails, they would have to wait for the application to process. Expect the application for the child to take 6-8 months.
  3. Find a new consultant. If they get that one wrong (which they have), I wouldn’t trust them with anything more important or complex.
  4. He need to remain in Canada (short trips are ok). He could return to India once the child receives the COPR and fly back with them.

Hi All,
My friend is in a similar situation - he and his wife are PRs, and they did the soft landing in October 2016. Now they have a 1 year old baby and my friend is coming to Canada (moving permanently). I understand that he will have to apply for his child's PR once he is here as he can only initiate this process while he is in Canada. In the meantime, earlier our thought was that he will apply for a visitor's visa for his child while the PR is in process, but reading through the threads it seems that the vistor's visa may not be a viable option afterall? Also, the current processing time for sponsoring a child is 10 months. Based on the current situation, I have the below questions:
1. Is there any different between Visitor's visa and a TRV? If yes, then which one should he apply for his child?
2. As I have read in multiple threads, it seems that TRV will most likely be rejected - is there any specific reason for that?
3. If TRV is rejected, he can apply for TRP - I tried finding information on how to apply for TRV on the CIC website, but was unable to find it. Can someone please help me with this link?
4. Can the TRV be applied while my friend is outside Canada?

Appreciate your help with the information in this guys!

Hi

1. Same thing.

2. The child is not a genuine visitor, as there is no intention for him to leave Canada.

3. Yes, it the TRV is refused, they can apply for a TRP. https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/inadmissibility/temporary-resident-permits.html

4. Yes.

One more question - as per the CIC website, the process for sponsoring a spouse or dependent child includes 2 parts - 1. your application to sponsor a family member (spouse or dependent child) and 2. your spouse or dependent child's application for PR.
My question is - are these two done at the same time as one application in the system? Or are these sequential and 2nd can be done only after the 1st is completed?
This is because the processing time for sponsoring one's spouse or dependent child as per CIC website is 10 months. Does this period include just point 2 or both 1 and 2?

Hi All, got a few more questions on TRV application
1. My friend is currently outside Canada, so who should write the invitation letter? - it seems that the invitation letter is mandatory. So can he still write an invitation letter for his daughter (from outside Canada)?
3. Does he need to create a separate account on CIC for his child whose TRV he is applying or can he use his account?
4. Also, what all needs to be provided as the proof of means of financial support and proof of financial support? - he is still in India so are the bank statements from India enough?
5. Also, there are two forms that need to be filled up and signed - looks like the forms are to be filled on behalf of his daughter, but since she is 1 year old, how can she sign those forms? can my friend sign those forms? I did not see any declaration or specification on the form for the parent or legal guardian signing the form on their behalf.
6. What is the required amount of funds that needs to be declared as a part of financial proof for the application?

Hi if you are a citizen, are you sponsoring your wife? So you and your spouse are the biological father and mother? Where was the child born inside or outside Canada? where the marriage happened outside canada?

The parents can try applying the dual intend visa for the child and start the PR sponsorship inside canada once the child is in Canada

Kindly note that there is no need to show the LICO to sponsor a DEPENDENT CHILD only if you are sponsoring a Dependent child's dependent child then you need to show the proof LICO
