Visitor visa with kids

Hi Bryanna/Seniors,

hope all is well and you have a great start to 2018!!

it has been some time since I last visited these forums, and I have a question regarding visitor visa.

I want to apply visitor visa for my brother along with his two kids who are in grade 3 and 4... wife is not applying as she cannot leave the job at the moment... I want my nephews to come on March break to meet with my son/ family and enjoy the vacation...

can you please guide me what documents do I need in order to apply for that? Last time I applied for my brother's visitor visa, he came and visited us last year and went back in one month, kids, however, do not have any travel history outside India...

Any suggestion/useful information is much appreciated!!!

1. Until when is your brother's TRV valid?
His visa was single entry only valid until last year, so he visited last summer for 3 weeks. He has to get visa too. Last time, he applied for an explatory trip to Canada (not invited from me).
2. How long would they like to visit?
Kids exam will over by March 10 and they go back to school in April, so we are thinking 2-3 weeks in between that.
3. When is their school break?
their schools break in March for 3 weeks (end of their term and they go in new grade) and after that by end of May (summer vacations) for 6 weeks.
4. Can your brother prove that he has some work and/or personal commitments in India to return to after his visit?
He is full-time employee and partner in my father's company. Yes, he has job letter confirming that, income tax, etc.

3. Does your brother handle work responsibilities that are entirely different from those of your dad? Is the company well established in terms of hiring other employees (who report to your brother) + audit reports, etc?

4. Your brother can apply under CAN+. Of course, the visa office would decide whether to process his application as CAN+

5. Has your brother traveled to any other countries (US, UK and the like) especially after his previous visit to Canada? Own property/land?

He works as Senior Manager in the company, and he owns 50% share in the company, it is totally legit, all documents are available to support this, same was provided in his last file.

Yes, he does the hiring, performance evaluations of employees he hires as one of his responsibilities as the senior manager in the company.

4. Your brother can apply under CAN+. Of course, the visa office would decide whether to process his application as CAN+
How do you send an online application as CAN+? He created his profile online but there was no option to choose CAN+, is it something he needs to mention in Letter of Explanation? Could you kindly provide a sample if possible?

5. Has your brother traveled to any other countries (US, UK and the like) especially after his previous visit to Canada? Own property/land?
No, no travel since his last visit due to his involvement in business, he didn't have a chance to plan any trip after his last visit to Canada. Yes, he owns a few residential/commercial properties, and they have been evaluated by architect and same has been assessed in CA statement.

These documents would not suffice.

He must also include: GST registration and at least one GST return + company profile + business is actively trading (2-3 proofs of work contracts, purchase orders, etc) + Audit report + Profit-Loss statement/balance sheet + 6 months' company bank statement + lease agreement for the office and 2-3 months receipts + Profession Tax certificate and recent receipt (to indicate other employees, if applicable), etc etc.

Most importantly, he must prove that your dad cannot manage the business/the responsibilities in the absence of your brother.

Quite honestly, for someone managing a business, March-April would be an incorrect time to take time off work to travel on holiday as that is when business usually peaks + there would be tax and other returns to prepare/check/file + employee appraisals, etc



2. Financial Support, i.e. CA statement confirming bank balances, FDs, savings, current accounts, property valuations employment letter, income tax returns
The CA's statement must be supported by documents for every aspect declared i.e. financial investments + property + how can a CA confirm the employment? + ITRs (the CA cannot add anything to this one).

Again, the CA is not adding value to anything. IMO, the CA statement is a 'white elephant'. Your brother would be better off by simply preparing a Statement of Personal Assets and Liabilities himself + including referenced evidence for every asset declared.


3. Inviter's Letter - Letter from me to invite him along with kids to visit and tour with my family.
Also, provide copies of your passport + financials (if you wish to provide these).


4. Travel History - Exploratory visit to Canada, trip to Singapore, Malaysia and Thailand in the past
Only the Canada visit would help. Other travel won't matter.


5. Proof of relationship - my birth cert with parents name on it and his passport's last page.His kids birth certificate

A day-by-day detailed itinerary with expense estimates + he must prove he can afford this itinerary and also pay for his and his kids' airfares (his personal finances.... company finances cannot be shown for this purpose).

IMO, this purpose of wanting to show the kids around Manitoba and get their comfort level won't convince the visa officer primarily because this is something his wife must assess more than the kids.

IMO again, don't focus on the Manitoba PNP and possibility of PR = Intention to remain long-term = Can backfire for a TRV

He would also need to include consent letter from his wife authorizing him to take the children abroad from XX to XX date + copy of her passport and her 24/7 contact information.
