entering canada through US border and sponsoring a child born outside canada

Dear Friends,
Me and my family have expired PRs and we do not meet the residency obligations. We know we can enter canada through US border even with expired PRs. The challenge is that we have a child who was born outside canada and has no PR status. My question is very simple that if i enter canada through US border, will I be able to sponsor my child born outside canada? Some posts suggested that once i enter i will not be able to sponsor for 2 years before my own PR is renewed. Your valuable advice and experience greatly appreciated as it will save me a lot of hassle

You won't be able to sponsor your child until you have met the residency requirement. If you try to apply for your child's PR before you meet the residency requirement, this will trigger a review of your PR status which could lead to your PR status being revoked. If you have been outside of Canada for more than three years in a row, this means you will have to live in Canada for 2 years before you will be able to sponsor your child.

In addition to not being able to sponsor child for 2 years, you also face the risk that upon entering Canada you'll be reported by CBSA for not meeting residency obligation which will start process to revoke your PR status.

I got a question in regards to this.... if they enter Canada via US border with expired PR cards, knowing they do not meet RQ and knowing they're not able to sponsor their child for at least two years, wouldn't that mean their child is somewhat illegal in Canada (after the visitor status is gone)? Wouldn't that be some kind of fraud and a reason to revoke their status (they don't really have at this point - yes, I know they're PR until the status is revoked by officials)?

They can always apply to extend visitor status of child as needed.

Even if they don't do this, having a child in Canada without status is not grounds to revoke PR status if they can somehow get back into compliance with RO.

Unless they are from visa exempt country, wouldn't they need to apply for a TRV for the child first? Wouldn't that possibly trigger a RO investigation as well?

The child would need either a TRV or visa-exempt passport. The TRV application may well be refused. As it's not directly tied to the parents immigration status, they might get away without being noticed.
