Hi,

You will be getting a SOWP with validity equal to the validity of your spouse's work permit.

For example - If you spouse have work permit with validity till 02/01/2019, you will be issued with OWP valid till 02/01/2019.

As far as I know, In your work permit there will be definite date printed on which you should leave Canada. You can work until that date.

This is not possible for a Non Visa Exempt country.

It has no provision of distinguishing between applicant's mistake vs CIC's mistake and I think the fee for amendment is like 1500 CAD. I know this, because a friend was issued work permit wrongly at Toronto airport. The officer said you are free to work any where in Canada and it did put location as Toronto where as the employer was in Quebec. So the company's lawyer had to file for amendment which took a month and costed above fee. Still I would say you can send a request for amendment describing your situation with proof also highlighting your concern. But as I said, when CIC asked for additional fees for Status restoration, my consultant submitted the letter saying that I do not require status restored, as I am already in status. My SP is valid until July-2016. My question is, would that letter, and copy of my study permit sufficient to prove that I had legal status? Or should I pay the consultant additional fees and try to get it corrected?

I am about to send copy of MY PGWP to my wife's application through CSE, do you think there would be any issue with this remark "TR status restored" on her application?

It is $250. I applied through VFS. They charged 12,600 INR as visa fee (excluding any other services and taxes). I totally paid 13,830 INR. Just take 15k with you :)

Please note - They accept only cash.

It will be a hassle free experience. It is a token system like passport seva kendra. First you pay the fees, eventually you will be called to another counter to submit the documents. The person at the counter check your documents whether you kept any irrelevant papers in it and they also check your application if it is correctly filled.

Please note - VFS is just an application collection center. They are not authorised to give suggestions on your application or documents. Please reach VFS by 9:30 in the morning so you can make sure your document is sent to the respective visa office the same day.

You will be given with an acknowledgement receipt after submission. Then you are good to go home and start praying for your visa approval. :)

3. In the Form IMM 1295, in background INformation section there is a question as "Have you previously applied to enter or remain in Canada?"
We are really confused with this question. My spouse is the principal applicant and had never submitted any application to Canada. But I have sent my PR application and I have added my spouse to the application as dependent. PR application is still in processing. So what should we answer for this question, should I say Yes or NO. What do they mean when they say enter or remain in Canada.
Also it says if you answer Yes for any question in the Background section, you have to submit schedule A form or IMM 5257B


Is it the PR application after the PR invitation or the Express entry profile ?. If your PR application in process and you are applying for SOWP, then it seems to be dual intent in my view. I suggest you to wait for FKL or some other experienced member's comments on your post.

Regarding question # 3 I have applied for PR under CEC in Aug 2014. What does it mean of Dual Intent? When I submitted application I wasn't married. Later got married and added dependent.

Another Question: In the form IMM 5905E, it says that you have to submit Original Passport, do we need to give VFS original passport while submitting the application or can we send them when we get Passport request for stamping visa?

TO my understanding, your spouse is applying for SOWP and you got married after applying for PR, right? In this case your spouse as an applicant applying first time to enter/visit Canada.

My spouse also for the same last month and Yes, you have to send passport along with the application because it says on checklist to submit original passport.

good day!

i am about to apply for a spousal open work permit for myself and study permits for my two kids. my husband is now in Canada with valid skilled work permit until 2018. My question is should I also fill up the form Schedule 1 – Application for Temporary Resident Visa (IMM5257 – Schedule 1)? If yes, am I the principal applicant or the spouse of the principal applicant?

Thanks for the info. I have seen that for some of the people they got the request to submit the passport and then they gave it to vfs and vfs send it to cic. Is it for different type of applications?

as my pr is in processing and I and my spouse get passport request, then would it be problem?

Not true. I've had 2 TRV refusals, got TRV the third time And now in Canada on a study permit, with spouse on SOWP and daughter on Study Permit as well.

Dual intent simply means that you have both PR application in process as well as submit a work permit application meanwhile. Because the intent of living in Canada is different for each (work permit says temp stay vs pr says permanently), it confuses people whether they can do it at the same time. This is perfectly allowed and accepted by CIC and is officially termed as dual intent. You can read more details by searching on the internet.

Coming back to your original question, the answer is simple. Since your spouse is already included in a PR application submitted before, it is counted as a prior application. So you would answer Yes and where ever you provide details, you mention that "i am a dependent in the PR application submitted by my spouse on date x currently in process, this is the tracking number"

outside canada application - SOWP AND TRV for my 3y/o son

after 2months and 22 days


i just have a question, need your advice.
My husband is under PGWP - open work permit. during the process of SOWP AND TRV application, he worked under NOC A.
Due to unexpected circumstances he needed to transfer to SK. now with a full time job under NOC C. he works in SASKATOON HEALTH REGION. 1 full time 1 part time with a high income (collated). we have a clear pathway for SINP, he only needs to work full time for 2 years so he can apply for SINP (International graduate).

we received a PPR letter through email. What should we do when we land there? Do we need to update or inform them while we are still here in our country of residence? Please need you advice on this. thank you...

Hi Kyle,

Congratulations. If you don't mind, would you share what is your country of residence? And previously you applied for visitor visa, or SOWP were refused 3 times?

For your question, here is the CIC link for spouse open work permit,

As you can see that it clearly requires that spouse who is in Canada must have job in NOC O,A or B. It does not ask for how much money he is earning, but the skill level only.

On the other hand, CIC strongly recommends that you update any changes to your circumstances, change in name, birth of baby, employment etc. I am afraid if they find that your husband is not in skill level "A" and you have hidden the fact, that may be troublesome for you.

FKL can shed some light on it, but that is my view.
