Dear All,
Can someone describe this rule please "183 days (minimum) per year in 4 out of 6 years."

- If I stay less than 183 days in "two years" plus more then 183 days in the other 4 years ( ending with equal or more than 1460 days in 6 years), can I apply for citizenship? or do I have to spend 183 days in "each" year at least?

Not True..... 183 in each of 4 years. So, if 0 days in two years, you remain eligible if acquired 1460 days in total. The best thing however for you is to log in your data and dates on the online residence calculator which will let you know exactly what and when you'll be eligible to apply.

You must spend at least 183 days in each of the 4 years immediately preceding your application.
In the remaining 2 years (year 5 & 6) you must accumulate enough days to reach the total of 1,460; or even 0 (zero) if you have enough days from the 4 years immediately before your application.

In other words:
Year 1 before application: 183 or more
Year 2 before application: 183 or more
Year 3 before application: 183 or more
Year 4 before application: 183 or more
Year 5 before application: ### (no minimum)
Year 6 before application: ### (no minimum)
TOTAL over 6 years: 1,460 or more

So if you have less than 183 in any of the immediate 4 years (year 1, 2, 3 or 4) or your total amounts to less than 1460, you are NOT eligible unless exempt from the physical residence requirement.

Response by spiritsoul is essentially correct, and I concur in the suggestion to plug dates into the online "physcial presence calculator" ("residence" calculator was used for pre-June-2015 applications). It is quite easy to plug totally hypothetical dates into the calculator just to see how various scenarios work out.

The response by banrad ironically cited the correct rule but nonetheless applied it incorrectly.

That is, the following is not correct:

That part is correct.

For clarity, I will restate the rule with key parts in bold for emphasis:

"You must also be physically present for at least 183 days during each of four calendar years that are fully or partially within the six years immediately before the date of application."

It is possible to reach the 1460 day minimum total threshold and not meet the 183 X 4CY requirement, but in practical terms there are only a few scenarios in which a PR who meets the 1460 day total does not also meet the 183 X 4CY requirement. In other words, the PR who meets the 1460 day total threshold will usually (but not always) also meet the 183 X 4CY requirement.

It is important to remember that the relevant six years relates to the date of the application, but the 183 X 4CY refers to calendar years, meaning the year going from January 1 through December 31.

Thus, for example, the applicant who applies before July 1 in any given year, say 2016, cannot have met the 183 day requirement in that year (there are only 181 days before July 1 in most years; 2016 is a leap year so there will be 182 days before July 1st, still not enough to meet the 183 day requirement for 2016 if the application is made before July 1st). So an applicant applying in the first half of 2016 will need to have spent at least 183 days in four of the following six years: 2010, 2011, 2012, 2013, 2014, or 2015, not counting any days prior to the respective date six years previous (in 2010).

Logically an applicant must have in total required days 1460 out of total 6 years.

The calculation of 183 per year is just a guideline. It is NOT a rule that someone can stay maximum 183 per year outside the country.

I strongly suggest you wait for another month or two after completing the required 1460 days to apply to avoid any calculation errors.

At times, people applied with exact number of required days but then CIC calculated different and found that to be insufficient.

Its in your best interest, apply with extra 30 to 60 days than required and you dont have to lose anything. You will have peace of mind.

Yes, you're fine.
Just remember that 183 days rule is about calendar years, and 1460 is about years counting back from the moment you submit your application.

Just use the online calculator to make sure.

To make it more clear I can give you an example suppose a person has 183+ in 2010, 120 in 2011, 160 in 2012,183+in 2013, 2014 and 2015, and his total days are 1460+ is eligible to apply for citizenship.

If I stay 4 full years in Canada , does this means I should Waite for an extra 2 year befor I could be able to apply for citizenship ???????

No,

As soon as you have completed the 4 years and you fulfill the other requirements, you are good to apply.

Along with Babi22's message, you still need to report your last 6 years of residency even if they were outside Canada. For example, a person landed in Canada in 2012 as PR. He/she qualifies in 2016. He/she reports 4 years in Canada, 2 years in native country 2 years in 2010 and 2011.

I think your statment is partially correct/wrong.

4/6 years apply for citizenship applications,
However you still need to have 183 days in 4 of the last calendar (Jan 1st to Dec 31st) six years to be eligibale to apply for citizenship.

It has nothing to do with keeping your PR status.

As far as I am aware, there was no change in the PR status requirement, you still need 2 years in 5 years to keep a PR status.
