Hello everybody, I have a question regarding imigration to Canada from Croatia

I'm Croatian and my wife is a Canadian citizen (she has the certificate) but doesn't have any other documents. We also have a daughter together.
We would like to go to work in Canada as a family but I'm not sure if I need a work permit.
As i understand, if my wife gets a Canadian passport, she and our child could go to Canada without any trouble but what if we
all go together? What documents do we need to go to Canada as a family?

Your wife has 2 choices. Outland or inland aponsorship.

Outland allows you to enter / re-enter Canada without affecting sponsorship process. It is usually the faster route to Canada. However you would be required to go back to crotia for any require interviews and passport requests before landing as a PR in Canada.

Inland allows you to enter Canada but you cannot leave Canada while sponsorship is in progress the entire time and it is generally longer timeline. One benefit of inland sponsorship is that once you pass 1st stage (Approved in Priniciple) you can apply for open work permit and allow you to work in Canada while PR is in progress.

There are pros and cons to each route. Discuss with your wife on which way you want to go and be aware of the limitations of inland vs outland.

Once your wife gets her canada passport, you and your daughter will be able to travel to Canada since you are from a visa exempt country. Having your canadian wife with you on entering Canada will give you weight in allowing you to enter Canada. Your wife will have to explain to border agent that she intends to sponsor inland or has already sponsored you outland.

Once you are in Canada, I would suggest you to get your daughter Canadian citizenship if she hasn't gotten it already assuming your wife is a 1st generation Canadian at time of daughter birth. Otherwise she would also have to include your daughter for sponsorship. Once daughter gain PR status, she can apply for Canadian citizenship right away without the 3 year residency requirement.

Was your wife born in Canada? If so, your daughter has a right to obtain Canadian citizenship. If your wife got her citizenship from a Canadian parent, I'm not sure your daughter is entitled to Canadian citizenship. Also, if you and your family plan on moving to Canada, you need to consider whether your daughter will need schooling.

The thing is, if Croatia is visa exempt, that only means you can visit as a tourist: working and studying are not allowed with this visa, for you nor your daughter.

I don't know much about how to grant your child the permit to study if she's not a citizen, hopefully someone can help you there.

In regards to your visa, you could enter Canada as a visitor (if the officer at the border doesn't deny you entry based on his belief you plan on never leaving the country, which is technically true and could happen) and have your wife apply for your sponsorship inland. This would allow you to stay during the time the application is in process. If you want to work, though, you'll have to submit a work visa application along the sponsorship application, and will have to wait until the 1st stage of the process is through (app. 6 months) to actually start working.

Another alternative would be to enter Canada, apply immediately Outland, and wait until the process is through. This means that a) you have to renew your visitor visa as many times as needed until you get approved, b) can't work at all during this time, and c) if you are requested for an interview, you have to go back to Croatia.

You don't need special papers to enter Canada. Having your wife with you will give you weight in allowing you to enter Canada and applying for inland sponsorship.

As noted above, if your wife was born in Canada or a naturalize Canadian, your daughter has canadian citizenship. But the processing time for your daughter to get proof of canadian citizenship can take anywhere between 3 to 12 months.

If your wife is a canadian citizenship by her parents being canadians and born outside canada, then your daughter will not likely have canadian citizenship. She would also have sponsor your daughter along with you. This can be a huge issue with schooling. She cannot get any schooling until your daughter gets AIP assuming she isn't canadian. My wife is 2nd generation Canadian. She was born in Croatia and her mother is Canadian. We were talking about going to Canada but I've heard about lots of different ways to go there. I know a family that went there with a work permit that the husband had and stayed there. That was about 4 months ago and they all have work permits. I've done some research and the 'legal' way is trough a work permit but I've also read about sponsorhip and that Canada does not seperate families upon entering Canada. So what would happen if my family went to Canada just like that assuming that my wife is a Canadian citizen with Canadian passport? I presume that we would be under the inland sponsorship but is there a chance of returning us all back?
Also, what would be the best way coming to Canada for us as a family?

Also, I have to mention that my wife didn't renew her certificate when she got it in 2001 and that she changed her surname into mine but on the certificate is her maiden name. Would that be a problem with and is there a way of getting a newer version of certificate with the updated data?

As far as I know it won't be a problem. It is advisable that the canadian citizenship certificate to remain in her original birth names, thus maiden name. This is for their record keeping.

Since she cannot change her maiden name to marriage name on certificate, she doesn't need to update her certificate unless she wants her picture to reflect her current look. Keep in mind, even though a new picture is submitted with application for new updated certificate, it won't show a picture of her in the new certificate.

Besides she shouldn't need to renew her certificate as they should not contain any expiry dates. If per chance that her citizenship certificate does have an expiration daten then she would need to get a new canadian citizenship certificate.

I just looked up name change for certificate, she can change her last name to marriage name if she so wishes. But generally if she keeps her maiden name on certificate it won't be a problem.

Could it be a problem if i send a picture of the certificate for you to see for yourself that it is valid? I've tried do send a picture but the img tags aren't working.

Tough rules. So lets say that the certificate is valid. What would be the best way of coming into Canada as a family?
Also, i am going to research everything that there is to know about this subject. Would you mind if i ask you some more questions
in the private messages in upcoming days? I don't won't to be rude and intrude your time but there aren't many people that i can
ask here in Croatia and the canadian website is massive and the informations there are alot to process without guidance.
