Hello,
I have read numerous horror stories about how Canadian Consulate has been utterly negligent and do not return passport to the applicants promptly even after withdrawing the TRV application. This has caused a lot of people a lot of stress and undoubtedly lost a lot of money due to not being able to fly. I'm not talking about flying to Canada, but flying back to the home countries etc. which was not possible due to Canadian Consulate's reckless behaviour. If my research is correct, holding someone's passport beyond that person's will is a crime and is almost equivalent to kidnapping. I am aware that diplomatic community enjoys immunity. That said, is it still possible to bring a class action lawsuit against these heartless and inconsiderate consulate workers? Has there been a precendent? I think I am soon going to fall victim to this and lose about USD 1,500 on a ticket that cannot be reschduled.

I've had bad experience so far with NYC Consulate. It would be great to know legal options available.

At this point, I am trying to establish the feasibility of such a lawsuit. Considering diplomatic immunity, it is probably not possible. But can CIC be held accountable in Canada for their actions in NY? We must act to teach these slobs a lesson and hopefully by doing that we prevent future applicants from falling into their ruthless trap. I welcome any input by those practicing law here... Also, if you are willing to be a part of the class action, please indicate in this thread...

Finally, I got the passport back but not before creating a scene. It was such a struggle just to get your passport back. Nobody should be subjected to such torture. The workers at Canadian Consulate are less than humans with absolutely zero compassion. 72 days of Visa processing was not enough for these slobs to stick a piece of paper into the passport. What a freaking shame on the whole country of Canada... I will never ever visit this country as long as they remain represented by such fools and will spread the words on their disgusting ways as much as I can. Seriously, I do not wish having to deal with Canadain consulate on my worst enemies... Thank God I have my life back and will never think of this country ever again in my life...

I am really sorry to hear about your problems getting your passport back!

Situations like this make me wonder if the people working at the Visa offices truly understand the impact that they have on people's lives.

Immigration in itself is such a brutal process for the average person who just wants to get on with their lives.

For the sake of our country I apologize for your struggles you went through.

Hello there. I am glad to read your documents are back to you. However, I would like to know if I can still support you, because I sent my documents to the Canadian Consulate in NYC last 25th March, and I don't have any answer yet. My flight was scheduled to this Thursday, and I have a flight for my country (Colombia) next 20th June and I am very worried I can't go because this people from the Consulate. I am getting really desperate and I want to be in touch with people affected like me to know what we can do.

Hi,

When did you apply and is it tourist visa or TWP? Mine is already 3 months. TWP applications and they have my passport.

I still havent received my passport.
I need to travel to India soon..like next week.
My documents reached the NY office on April 8.
I went there in person to withdraw my application on May 22.
They said they'll send it to me instead of handing t over to me then and there.
It's MAy 31 and there is no sign of my passport.
I'm getting anxious with every passing day..I really have to go home..
How did you get your passport back at the office?? What did you do?
