Does your employer already have an LMIA? Is this a GSS application? If regular WP applications have been taking close to 6 months.

My sister in law just received her copy of lmia and contract to apply for employer specific work permit. she just been approved yestersay on her visitor visa extension which has been extended till the end of may . will changing status for work permit give her implied status once her record expires or will she need to extend her visitor visa and wait on her work permit and keep extending her stay till she hears from her work permit application?

Once she applies for the WP, She would be on an implied till a decision is made. But she has to apply for the work permit before the visitor record elapses, If she is unable to submit the work permit application before the validity date, She can apply for the visitor extension again.

Thank you ! That's reassuring. what did you put for this requirement "" proof that you meet the requirements of the job being offered"" " i don't understand what they're asking. My wifes friend whose a nanny only provided lmia, her contract and passport. She didn't provide anything that prove she could do the job she didn't send any copy of her educations. We asked her and she wasn't sure either because she used a agency .

"Under the proof that I meet the the requirements of job offered ". I attached my CPR certificate, BSC degree and Wes evaluation, Past Employment offers and references, CV, certifications awarded at my previous work place. The job offer I got is in line with my previous experience, So I was able to proof that.

Since it's a nanny job, let her send her degree certificate through webform , If she has any or get a cpr certificate. I think it's around $250 or so. I would advice she attach atleast a cpr cert or degree cert just to prove she she meets the requirements.

I don't think the CPR course will be sufficient. I think she would either need to show paid work experience in the field or alternatively have completed a degree or college diploma in the field.

Thanks for the reply. So to me it doesn't look like she's going to be approved based on that. She's been so excited because of that announcement canada made about visitors in canada being able to apply for employer spacific work permit with lmia, so she found an agency (it's the same agency that her sisters friend used and has been working here for the past 3 years) they found an employer that was willing to take her on and sponsor her and willing to train her as well. They even have the approved lmia in her name as well. At the beginning they even asked if it be an issue because she just graduated from high school and they said it's no issue at all. On a side note she didn't pay anthing

I think she will be approved regardless. It's a skilled level c job, and it doesn't really require much certifications. Please, don't be discouraged. Go ahead with the application. Attach work reference letters from her cousins and go ahead and apply. Best of luck

""Ministerial Instructions (MIs) implemented on June 18, 2019 and revised on April 22, 2022 instruct officers to refuse to process work permit applications received under the Temporary Foreign Worker Program (TFWP) for caregiver occupations in specific circumstances.

The revised MIs

  • clarify that the refusal to process work permit applications for the specific occupations (National Occupational Classification 4411 and 4412 – home child care workers and home support workers) includes applications submitted at ports of entry
  • prevent foreign nationals currently not authorized to work/study (whether they are physically inside or outside Canada) from obtaining a new caregiver work permit under the Temporary Foreign Worker Program unless they are exempt
It is expected that such applicants should apply through the Home Child Care Provider or Home Support Worker pilots which allow for a clear pathway from temporary to permanent residence.
