Hi, I am a skilled worker in Alberta and my Work Permit and Visa expire on 30Sep2010 which is a month from now.
My employer has filed an LMO application 2 days ago(As my employer was out on emergency business convention for the last 2 months). I am in a really bad situation because I am not sure what's going to happen as I have very little time for everything.

My questions:-

1) If I don't receive the LMO within a month. Do I have to leave the country? Is there a way I can stay?
2) I've heard of the "VISA RESTORATION" but for that I have to wait for my permit to expire and on the gov. website it says its illegal to stay in Canada after your work permit/visa expires.

Please if someone can assist me with a real solution then I'd be really grateful!!

Hi, Ashish Kumar

My suggestion is that just send application for "Renewal for wrok permit" with cover letter and mentioned that employer already applied for LMO and will send you ASAP once you get.

Once you applied for extenison of your work permit your status will be called IMPLIED status and it is not illegal,

Check your self on cic regarding Implied Status

Again this is only my thinking, you have to thnk youe self or call 18882422100

Sorry it took me a while to call CIC as they are mostly busy on MONDAY through WEDNESDAY
ok so here it is....

According to CIC I can send the work permit application stating that my LMO is still in process and mention the confirmation number so that they can take a record of it. This procedure will buy me implied status.

I believe the Call centre gave you wrong information, as there is no longer any concurrent work permit processing without an LMO.  See: http://www.cic.gc.ca/English/work/processing.asp#tphp%20idtphp

About 4-8 weeks for most these days.

So does that mean that there is no way I can stay in the country till the time my permit is renewed??

hi!
my husband also experienced that problem! his work permit, LMO and visa has xpired last april ,2010. some say's that he should leave cnada asap when he recieved a refusal letter. but last month, he got his LMO and now his workpermit is still on processed . when he called CIC , he recieved the application form for renewal of work permit and told him to pay for the restoration! so pls. dont lose hope!

They are still doing it in Vegreville.  You have to send proof that the LMO is pending (confirmation of receipt from HRSDC and file no.) with the extension application but for now, it's still being done.  ONLY in Vegreville.

How can I apply to Vegreville?.....do they have a separate website than cic.gc.ca? Do I have to post all the required documents to them instead of Edmonton?

Please explain as I am not that knowledgeable about the procedure.

Aasish i would advice you to call them again as above link say they dont accept application without BALID/ LMO  it doesnt mentioned that LMO in process cant send application Smiley so you should again call them without wasting your time and explain whole situation ....

The online application for a work permit extension still allows you to submit the application with "LMO applied for".
