My husband and I have been residing in South Korea for the past year, while awaiting for his aprooval under the family class.  I am a Canadian citizen, he is a Nigerian citizen.  We are processing through Accra Ghana.  It has now been 11 months since we have applied, and about nine months since there have been any updates on our account.

My question is in regards to a visitors visa.  I am working at a school in S.Korea, and will have holidays in february.  We would like to be able to go home to Canada and visit my family.  I have a contract here with my school, we will also have roundtrip plane tickets as well.  The issue is that he is here on a spousal visa to stay with me.  That means he cannot work, therefore he has no evidence other than his roundtrip ticket that he will be returning to Korea.  Is the fact that I am traveling with him, and that I will have my contract enough evidence for them to aproove a visitors visa?  I have called the embassy here in South Korea, they said they have no idea until I apply, and of course that will cost us over $150, but isn't guaranteed to be aprooved.

Does anyone have any experience with this, or any answers that might help us to decide if we should apply for the visitors visa or not?

Very difficult for any of us to give you assurances about whether or not a visitor visa will be approved.  All you can do is apply, and provide as much proof as possible that you both intend to return to South Korea at the end of your holidays.  Your job contract will help - but that still doesn't prove that he will return . . . so it's a gamble.  Guess you have to decide whether you can afford to spend the cost of airfare and the $150 when there are no guarantees - but, normally, foreign nationals from non-visa exempt countries who have applications for permanent status in process are unable to "prove" that their intention is to stay in Canada only temporarily and their application for a visitor visa is refused.  Now, under those circumstances, the partner is normally in Canada (not living with the spouse overseas), so your situation is a bit different.  Honestly, it could go either way.  The processing timeline for Accra is 8-18 months, so you're right there within normal processing timelines . . . and probably pretty close to finalization and being able to go to Canada for good.  If it were me, I think I'd save the money for the "landing" trip.

Thanks for your input.  I think your points are valid, and very helpful.
