Hi Friends/ consultant/ and experts
it would be very helpful if you can guide couple like us, here is my frustration.
i have done 3 year course in Canada and graduated in April 2009. now i have been granted 3 year work permit until May 2012.
during Feb and Mar 2009 when i was in school, my wife(from India) applied for open work permit under exception C42. (as Wife of International student qualify for open work permit)
she got REFUSED both time with the reason such as
-> " You dont have suffient ties to home country" and
-> " You didn't convince me that you will leave Canada at the end of term"
[.] Note: she earlier in 2006 applied for perm ant Residency as skilled worker from UK when she was herself student in London, uk, after that we got married in 2008. and i came back alone thinking i will apply for her after wards..
now being refused twice the frustration is increased too much.. 3 days before i got three year work permit, but i don't have JOB yet, she managed to get Job in INDIA from last month.
Now below are my question regarding above situation.
1. it is okay if we apply again, considering i dont have job ?
2. what was the reason why immigration officer refused us (as expert perspective) ?
3. she was not doing any job in Feb and Mar, was that reason for refusal ?
4. do we qualify to apply now as Excepmtion c-42 (spouse of work permit person) or not ?
5. do we need any LMO for her ?
6. can you suggest some STRONG point to argue when we apply next time...?
i would greatly appriciate any help/advice or suggestion..
please help me
