Author Topic: What if AINP nomination approved but H1 expires before CIC approval?  (Read 1867 times)

I am sure I will have the AINP nomination approved before the H1 expires. But I am wondering what will happen if my CIC application is in process and I have to leave the US?
I checked AINP FAQ (http://www.albertacanada.com/immigration/media/h1b_FAQ.pdf), but it only talks of the possibility of H1 expiring before AINP nomination.

Does anyone have any idea?

CIC application can be processed in your home country.

or.. change status to F-1 (student) or tourist... then you can stay here while process pending.

CIC application can be processed in your home country.

Hi I am also struggling to find some concreat answer to this..planning to mail AINP about this.....but thinking of wait till i get nomination....does anyone faced this siutation before...

AINP FAQ says about being in status till AINP issues nomination...
then down there, there is question...what if i move Huh answer says notify AINP and Buffalo.. but does not say will the decision be based on that ?
I know it can be either in Buffalo or Home country.. ?? but trying to find what happens if status/ Address changes after appling to CIC..

CIC application can be processed in your home country.

Jasper is right, you can transfer the case to your home country incase you need to go back

Dear All,

I am in a peculiar situation.

Right now I am in India on a vacation. I got a request for visa/approval notice & most recent paystub on 25th of Nov which I duly forwarded. Unfortunately I was informed by my employer yesterday that my project has ended abruptly due to budget cuts and asked me to stay back. I have a valid H1-B till 2010. Can I continue with the process in case I am nominated?

please advise.

What is the procedure for transfering file to the home country, in my case from USA to India. Please advice.
