Can you stay in Canada after you receive positive LMO and have applied for Temp Work Visa?

Passport says I must leave Canada very soon, If I have filed my application electronically can I stay in Canada while I wait?

It depends on your status in Canada. The visa in your passport is just for entry purposes.  So what is your current status?

Was there a date on the stamp made when you arrived in Canada aside from the date of arrival? If the second date is June 25, you must leave Canada on or before that date. Or you can send an application to extend your visit citing waiting for WP as the reason. Make sure you attach supporting documents with your application-fee, application form, document checklist, marked pages of your passport (entry in Canada), bio page of passport, and application must be received by vegreville on or before the 25th of June. You'd be on implied status. Else if you're not able to complete and send the documents for extension, you can apply for restoration of status within 90 days after your allowed visit is over.

Visitor but must leave by June 25, so I only have a few days.

ok the LMO is going to take lots longer than they initially said it would, so now I assume I have to try to extend my visitor status.

Can I stay in Canada while the extension application is being processed?

Yes, send extension application thru courier so it reaches vegreville before June 25. Read the instructions carefully and submit required documents especially stamped entry to Canada and bio page of the passport. You'd be on implied status and can stay till you receive a response - a visitor record or a letter of refusal.

Just a quick question about your answer dear job_seeker. You said: application must be received by vegreville on or before the 25th of June to have implied status

I always thought it must be send prior or by the expiry date of status and CP stamp would be a proof for submitting it on time if it was the case. Hope am right! I sent mine a month ago on May 25 via Xpress post and it arrived early on 27th, but status expiry date was the 26th. Am I legally allowed to work now?

Well OP said his or her status will expire on June 25 so s/he should send his or her application for extension before his or her status expires. Sorry, I am not aware of your case. And CP? Can I buy a vowel?

I sent my WP application a month ago to Vegreville. That was done on May 25 via Xpress post and it arrived early on 27th according to Canada Post (CP), but my current status expiry date was the 26.

When I saw you said applications must be received in Vegreville on or before expiry date, my heart stopped. I began to wonder if I was really on implied status and legally allowed to work. You see, I always thought it must be mailed prior or by the expiry date of status and Canada Post stamp/receipt would be a proof for submitting it on time if it was to arrive after status expiration, like in my case. Hope they didn't change that!!

No. A complete application package must be received by Vegreville on or before the expiration of your status. Call CIC and see if they can check the status of your application. Explain what happened. If they received the application after your status expired, you can still send an application for restoration before the 90 days is over.

Actually, the Canada Post stamp will work.  I've seen colleagues argue this and win.

If there is truly a mistake on the part of the IO, you first call the Call Centre and get them to see the mistake and get them to send an urgent message to Vegreville.  They will only do this if they can see the mistake too and you have to be really nice.  Smiley  If that doesn't work, you pay a fortune for Lexbase and get access to all of their secret names, phone numbers and fax numbers and send a fax to the manager explaining the mistake that has been made and request that it be reviewed again.  Tongue  You have to have proof and/or legislation to back up your position and explain yourself well.  You also must do it quickly.  I've never had to go further than that.

Thanks rjessome. I better save up then Smiley because I unfortunately have had bad responses from CIC (inconsistent answers and rude agents Cry) At least I know that I have a recourse in case something similar happens.
