Author Topic: Visiting USA after expiry of TR Visa but with valid Work Permit  (Read 1705 times)

Hi,

I came on a 1 year work permit to Montreal from India which expires on 15th October, 2010. Accordingly, I have a TR Visa till 15th October, 2010. I have applied for extension of work permit for another 2 years and hopefully in 1 or 2 weeks, I will get it.

I presume I could continue staying in Canada after I get the work permit even though my visa expires if I do not go outside Canada. Is it right?

Another thing is I have to visit USA for a conference on 30th November and I have a valid USA visa. I was told that for USA, I can still visit USA and come back to Canada without the valid TR visa? Is it true? Please help.

If you leave Canada during your authorized stay, you must get a new visitor visa to re-enter Canada.

There are two exceptions: you can visit the United States or Saint-Pierre et Miquelon and return to Canada without getting a new visa, as long as you:

return within the initial period authorized by the immigration officer or

have a valid visitor record, work permit, study permit, or a temporary resident permit (authorizing re-entry) and return within the initial period authorized by the officer.

Just one more clarification. In one of the postings, it was written that I can come back to Canada without valid TRV only on Bus or Car but not by plane? Is it true?

No, BUT it is unlikely that the airline would board you once they see "not valid for re-entry" on the work permit and an expired TRV.  The airlines don't understand that you can visit the US and St. Pierre et Miguelon on an expired TRV if you return to Canada within the validity of your admission.

Hi Friends,

             I am here in Canada on Work Permit my work permit is expire on 24 Nov 2010,and my girlfriend expecting baby on Jan 2011.i live with her since from March 2010 as conman law partner.we buy house here.i am very confused what i do.please help me.

I am just wondering, if you could share your recent experience on this issue. Have you attended the conference you mentioned in US on expired canadian VISA?

was there any problem in re-entering? did you enter through the land boarder or airport?

I am in the same situation as you Budha...
can you share your experience with us. Theoriquelly it's possible but on the pratic nobody nows how can you can Board at the airport with an expired visa...
